Confirmed: Lerner Participated In Persecution Of Tea Party Groups (From Human Events)

It seems like only yesterday that IRS Director of Exempt Organizations Lois Lerner was claiming she knew nothing about the dastardly work of those shadowy "low-level employees in the Cincinnati office" - who somehow remain shadowy to this day, despite having been blamed for the worst abuse-of-power scandal in living memory. The Incompetence Defense beloved of this administration, and so effective with a media that would never accept it from a Republican official, was deployed with gusto. Lerner was shocked, shocked, to discover gambling against Tea Party groups going on at Rick's Tax Exempt Organizations Cafe American.

But now National Review has uncovered documentation proving Lerner was up to her neck in the operation, over nine months after she claims she learned about it:

I think Hillary would look good in an Orange Jumpsuit, as she jumped out of a plane (without a parachute). Better to see where she impacts.

Pelosi looks like she’s orange so we save some money by just painting stripes on her. Is Alcatraz in her District?

Not so sure they can sue her civilly, personally vs. in her official role @ IRS.

There is case law that says it can never be the duty of a public official to commit a crime. She can be sued civilly.

But wouldn’t they have to prove she committed a crime first? And who expects this DOJ to do that?

I wouldn’t mind seeing Holder join John Mitchell’s elite club of AG’s who’ve gone to the slammer.

Her pardon is already written out.

Obama might be able to pardon her for crimes, but he can't stop Congress from holding her for contempt or perjury.

A conviction is not required before suing someone civilly. However, if someone is convicted of a crime and there is also a civil cause of action, the plaintiff wins automatically with only damages to be determined.

As a practical matter, how far do you think the plaintiff(s) would get without a criminal conviction? I can think of OJ, but not many other instances. In that case, too, it was a handy change of venue. Regrettably, venue more than the law determines the verdict. IMAGINE suing an Obama Administration official in the DC federal court. ha!

As a practical matter, if she is sued, the plaintiffs would be entitled to discovery of hundreds if not thousands of pages of documents.

Failure to produce them would be a legal admission that what they are alleged to include would be accepted as facts by any court.

I think, in Lerner’s case, it’s just the smugness of having had power over others.

1). Being in her position, everyone hates you, but kisses your butt out of fear.

2). Since it is obvious, you end up hating their hypocrisy.

3). Once on top, you realize that any ‘personal anxiety’ can be quieted by using your power over others.

4). When you see everyone ABOVE YOU doing the same thing, you use your power to go after everyone you don’t like or who gets in your way.

We all dream in our wildest and most wonderful dreams of not just impeachment in the House (which could certainly happen with a simple majority, like with Clinton), and removal from office in the Senate, but to get 67 votes (2/3rds of the members present as required by the Constitution) in this Democrat senate is an absolute impossibility no matter what he does.
