Was it a toy gun or a BB gun or both?My guess is that there was a toy gun at the park. The BB gun was found when the police went to his home and arrested him.
Toy guns, BB guns, handguns, rifles, shotguns, fully automatic weapons and so on would be legal every where. I just have to laugh at the utter stupidity of New Yorkers. They built their utopia. I am prepared to stop its spread.

The toy gun was a plastic pellet gun that shoots plastic pellets. Being hit with a rubber band would be more painful. Plastic pellet guns are not BB guns in book, but Bloomberg would argue that point since he knows everything about guns.

If I were the guy, I would hire a lawyer to research the statute prohibiting 'toy' and/or 'BB' guns. I have my doubts that one even exists. If it does not, both the city and the snoopy snitch could be liable. Press charges and sue the hell out of them.
