“Leaders at all levels must balance constitutional protections for an individual’s free exercise of religion or other personal beliefs and the constitutional prohibition against governmental establishment of religion,” the regulation states.

The problem is that nobody but Congress can violate the 1st Amendment imo. And the only reason that anti-religious expression judges get away with legislating religion-targeted hate "laws" from the bench is because citizens are not taught the difference between legislative and judicial powers.

What am I overlooking?
