Here is the filing of the complaint filed by the Department of Justice against Dzhokhar Tsarnaev, the 19-year-old who is accused of carrying out the attacks on the Boston Marathon that killed at least three and injured hundreds.

Doesn’t matter what complaint says. If they give him a civilian trial after the irregularities of his detention... He’ll almost certainly walk free. (The obvious intention).

The evidence laid out in the complaint demonstrates that.
What irregularities? That he wasn’t immediately Mirandized? At worst, that means that anyhting he said before being Mirandized can’t be admitted against him. But they won’t need any of that - there is plenty of video evidence agaist him (not to mention the whole chase/throwing IEDs at cops/shootout issue).
There are a lot of uninformed kneejerk comments on this point.
Not much of a limiting factor given he wasn't capable of speech when arrested or at last report. Speculation he shot himself through the mouth damaging his throat.

Watching a memorial ceremony and moment of silence for the victims of the terror attack. What I find distasteful is the appearance of the Gov, mayor and usual pols ... Like they were the individuals involved in the 10 minute gun battle with the two terrorists.
True, though there are reports that he’s been answering questions in writing, and the same point would also apply to those writings.
The point being, this guy is never going to walk free.

Justice delayed is justice denied. It’ll take decades to get this guy tried and through the endless appeals process, a delay eagerly supported by our progressively politicized justice system and sycophant press. He’ll probably die of old age before it’s all said and done. A military court would’ve made short work of him. Fair trial, quick hanging. Done.

Wait a minute!!! There's something missing between 18 and 19. Oh yeh -- all those friends, associates, "patriots" in Boston calling in to identify these two known killers. How many called these two instead to warn them rather than calling the police???
Another OJ. World’s best lawyers will clamor to represent him. Money will pour in from overseas to pay for it. And even if he does get jail time, there’s no need to recount the hundreds of killers who’ve been freed over the years by the courts. It’s now far from certain he’ll receive appropriate punishment, a lot less certain than if he’d been tried as an enemy combatant. No wonder people are upset. This stinks.
No, the FBI will be scrambling to look good after their obvious screw ups on this one. There will be more arrests (or at least arrest warrants) coming.
All of that in between stuff has no place in the criminal complaint. The complaint is designed to tell what the defendant did that led him to be charged with the crimes listed in the complaint. Whether or not he was called/warned/etc has nothing to do with the crimes he is charged with.
So according to this the car owner escaped. They didn't let him go.
It will certainly be interesting to see what their phone records reveal.
