I would support a treason charge though, I don’t think they will do it. I just hope this administration does not do like they have done with the Benghazi attacks/ on our Embassy in Libya; the cover up. I think he should be questioned soon. (to get info/to prevent more attacks/to out the cells). I read that he’s responding to limited questions by writing. His older brother did not have a job though he owned a new Mercedes and wore expensive clothing. Who was his financial support system. One of his uncles even said that both were in radical Islam.

Under that Constitution he has the right to a speedy and fair trial, followed by a first class execution. I suggest a public hanging.

Right after 9/11, our borders should have been locked down. We have the resources and personnel. The whole focus should have been that it would have been easier for a terrorist to pass through the eye of a needle than getting across our borders. Another point is that no more Muslims should have been allowed to enter our country. Hell, we have them from Saudia Arabia, Iraq, Iran, Somalia, Palestine, Chechnya, and God knows where else now. Just a handful of people are continually putting this great nation at risk of catastrophic financial and National Security disasters. There aren’t words for me, and others obviously, to describe our collective fury towards the rulers who couldn’t care less. God how I hate certain people in this country.

I go back to the Ann Coulter theorem that liberalism is a mental disease. They are wrong about terrorism, wrong about morals, wrong about the economy, wrong about evil, wrong about immigration, wrong about gun control, wrong about capitalism, wrong about national defense. etc. etc, The only thing liberals have is 52% of the American people. Disaffected minorities, women who have had abortions, people who reject God’s plan for marriage, idiots who have been brainwashed by ivy league 60’s professors, etc. etc.
I thank God I have lived during the times of Lady Thatcher and Ronald Reagan!

That’s a good point! I had not thought about the treason aspect....lulled asleep. I thought that since he was not captured on a battlefield where our troops are engaged in combat that a military tribunal was a no go.

So would a charge of treason be required to be prosecuted by military tribunal?

How would the charge of treason affect the charge of terrorism? I just don’t know enough about military tribunals,etc.

I believe Judge N. was giving a legal opinion based on his interpretation of the constitution and law rather than supporting or being easy on this bomber.

Disagree.

The oft-used "slippery slope" argument with regards to Govt abuse of power has too often been proven correct in the 20/20 vision of hind sight.

How "treason" is defined today will no doubt "evolve" to fit the political agenda of this and/or future administrations. Dzhokhar's bombing acts are "treason" today, Joe Six-Pack's defiance of NY or CT's gun laws are "treason" tomorrow.

If Dzhokar is a US Citizen he should be tried as such with full Constitutional Rights. We may end up learning something from his trial - perhaps about our own government's gross negligence and/or wilfull misconduct.
