Does not appear that they were even enforcing the law in Montana. They weren't, and aren't any where that I can tell. I guess some people want a law that will never be enforced to remain on the books anyway.....

Gay sex is not an express, constitutionally protected right. So I’m wondering if such laws are “unconstitutional” based on pro-gay, PC interpretation of certain clauses in Section 1 of the 14th Amendment. Note that since Section 2 of 14A discriminates on bases of sex, age and citizenship, pro-gay PC intretations of Section 1 are bogus imo.
