New York City is asking appeals judges to reinstate a ban on supersized sodas and other sugary drinks, which was struck down by a Manhattan judge the day before it was to go into effect.
The city had vowed an appeal and said Thursday that lawyers had filed it late Monday.
In his decision on March 11, State Supreme Court Justice Milton Tingling said the 16-ounce limit on sodas and other sweet drinks arbitrarily applies to only some sugary beverages and some places that sell them.

Nanny State PING!
Is the big gulp soda really the most compelling health issue in NYC? Will a ban really impact anything? Has government gotten to the point it really wants to micromanage soda consumption? This is what city lawyers want to clog the courts with? Does Bloomberg have any idea that 99 percent of the citizens think he’s a jackass?
Because NYC just can’t waste enough of their taxpayers money trying to control them! I bet the Clymer in charge would love it if he had control of their groceries from the store to their door!
Ironically, 7-Eleven’s Big Gulp was exempted from this ban.
The law wasn’t stupid enough they spend money to defend it.
Something wrong with those New York folks.
Is that because they aren't a "restaurant" by some obscure NYC legal definition? Or is this another case of crony capitalism?
Bloomy got lotsa lead in his water.
Nanny Bloomers will show those rebellious New Yorkers who decides how much soda they get to drink!!!!!Oh! Wait.....

Fat chance...
The North Koreans and Iranians are threatening to blow up the whole world, and these dip sticks are worried about how much soda people drink. These slime sucking scum bags are nothing but a bunch of idiots.
well they did keep putting Mayor Clymer back in office so I guess they want someone to control their every act. Just another good reason to avoid NYC.
It’s not about health with him, it’s about asserting his power. He bans smoking, soda, eating, guns, and everything else under the sun (0n average he bans something new once a week) yet he constantly promotes bike riding which kills more and more people every year, the most famous death being the sister of Alan Dershowitz who was crushed by a UPS truck around 2 years ago.
So in other words, don’t smoke, don’t drink big soda, eat fatty foods, o this or that or have a gun, but telling school kids that riding a bike around multi-ton trucks, speeding taxis is OK.
Here’s one I read about last week...........
Answers in order: "No". "Yes - every time a ban like this goes into effect, a bit more freedom is lost and politicians become a bit more powerful". "Yes - the government wants to micromanage every part of our lives". "Why not - lawyers care more about billing and double-billing than what's right". "No, but if he wasn't so full of himself to be able to miss that he's a jackass, he wouldn't really care because he can always impose a ban on that kind of thought".
What a waste of freakin time, money, resources
All the problems NYC has and they wallow in this crap
Bloomie’s gonna go to the mat over this one.
that enema nozzle of a mayor down there should be using his OWN MONEY for defending his OWN edicts and NOT taxpayers money!!!
If Bloomberg were smart, he’d let the ruling stand. By appealing it, he’s keeping it in the news.
Not that I mind him not being smart.
