Anyway, the law is what it is regardless of your beliefs and if you’re happy trusting the police to always get the right guy and use whatever tactics they see fit up and including homicide then fine. Just pray you or someone you care about never gets into the wrong crosshairs.
Where did you come up with that load of BS? When you point a gun at or fire it at an LEO you'd better be prepared to get return fire.

In this context I believe that “burners” is their slang for cage devices used to contain pyro tear gas devices and reduce the chance of starting a fire. The times when we used them they were put at an entrance or on a non-combustible surface. They allow a considerable quantity of agent to be introduced. I was always very leery of them.
However having concluded that this was a ‘green light’ scenario the PD may have said ‘fire or gunfire, what’s the diff?’’ Not saying it passes Constitutional muster but they’ll argue that in court ex post facto.
Back 90 to 100 years ago my department used dynamite after a siege resulted in a couple of LEO deaths. That’d get the ACLUs shorts in a knot today for sure.

Are you nuts? The perp had shot and killed one deputy and wounded another AT THAT CABIN. He was still shooting and trying to get away.
I don't know on what planet a running firefight does not represent imminent danger, but it sure as heck isn't the one I am on.

Listening to the scanner yesterday was upsetting to me because first they say ‘we are going to go with the burn plan, like we discussed’..’..then..’burners deployed’ and a few seconds later ‘we have fire’...like it was planned and the resulting fire was as well or at least the expected result. I don’t care about Dorner one bit, but I do care about the process, the rule of law and private property rights. I think that most cops do as well. Why else would it also have been said on scanner ‘maintain discipline’?
Do I understand their righteous anger and possible vengeance mindset? Yes. Should they be allowed to operate that way without question? No.
If the audio of some of them shouting ‘burn the MF down’ are true, then we probably have our answer whether discipline and the rule of law was indeed maintained at all times during the event. For the sake of everyone in law enforcement and the general public, I hope there is a credible review of the events that the public can be satisfied are true and that the force acted within the laws of our constitutional government at all times.
