Should be an interesting show today, considering the court ruling against presidental non-end-of-session recess appointments.

This is a funny blast-from-the-past:

Sen. Obama, who has taught courses in constitutional law at the University of Chicago, has regularly referred to himself as "a constitutional law professor," most famously at a March 30, 2007, fundraiser when he said, "I was a constitutional law professor, which means unlike the current president I actually respect the Constitution."

just ignoring the court

but the decision was focused on the recess appointments clause - ‘the recess’ and what positions he could appoint during a recess - the judge said he could only appoint people if the position was vacated during a recess

why was the focus on that - and not about the question ‘was congress in recess?’

i think this governs what is required for a recess:

article 1 section 5: Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting.

THAT did not happen - they were NOT in recess
