Obama may Ignore the Debt Ceiling and Suspend the Constitution: Obama and the Debt Ceiling

The debt ceiling is the last leverage that Republicans have to prevent out-of-control Federal spending and on various policy issues. Liberals know this: even as Senate Democrats talk of ending the right of Republicans to filibuster, liberals are seeking to defang the Republican House of Representatives as well. They are also now peddling a new theme that the debt ceiling itself is unconstitutional under Section 4 of the 14th Amendment. Therefore, President Obama may simply ignore the debt ceiling.

The looming debt ceiling fight could allow Republicans to soundly defeat Obama's overspending. In the "fiscal cliff" deal, Republicans succeeded by making most of the temporary Bush tax cuts permanent, but failed to get spending cuts. Yet now, Republicans could use the debt ceiling vote to slash spending. The overall result could be serious deficit reduction at lower permanent tax rates. But this requires Republicans to stand united and refuse to raise the debt ceiling.

Section 4 of the 14th Amendment requires: "The validity of the public debt of the United States, authorized by law... shall not be questioned." Liberals argue that if Congress has authorized spending, this automatically gives the president the power and even the obligation to borrow whatever it takes to spend all the money for which Congress voted. When Congress votes to spend money, this includes the obligation of the chief executive to take whatever actions are necessary to pay the debts of the United States Government. That is because "the validity of the public debt" ... "shall not be questioned." Thus, any debt ceiling law violates Section 4, they argue.

Suddenly the appeal for Washington to abandon the U.S. Constitution from Georgetown Law Professor Louis Michael Seidman in the New York Times makes sense.

Unless we win the Senate in 2014...impeachment is a fantasy...

Obama could rape little boys and slit their throats on the WH front lawn with Chris Matthews doing live commentary and the current Senate would never vote to convict him...

plan needs to be, if barky ignores the debt ceiling, then the house needs to refuse to pass any appropriations at all this year, shutting the entire government down, stick to it and mean it. the government is funded one year at a time, so when funding runs out, that’s it.

4. The states are on notice it is time for them to begin to reform a New Constitution by convention process.

No one will enforce the Constitution we have now, how is a "new" one going to be enforced?

Besides, you want this current crop of weasels crafting a new Constitution?

Great point. It would end up being a 6 volume set of heavyweight doorstops. They would have to pass it to see what's in it.

The COTUS has been suspended for a while. Anew COTUS will just give the elite the opportunity to legalize that suspension. Al Quaeda has left us intact domestically because we are destroying ourselves.

If Obama Suspends the Constitution. Must he also declare marshal law. Is the military then obligated to defend the law and the Constitution? No Constitution, No Obama Commander in Chief, leaving the door open for a coup by the military to restore the CONSTITUTION.

The Constitution is a contract with the States and the citizens of the nation, If the contract is suspend IE Broken then all bets are off Right? In other words it can be see as an act of aggression by the then invalidated non-representatives. After all they only get their authority from this Contract (Constitution) to begin with!

I want the states to reform a new constitution, not the jerks in DC. We hold power in a majority of the statehouses. Now is the time to do it before they get polluted too. The areas I’d dwell upon to make certain over what is currently in the constitution are limited terms of office, stronger amendment 10, designation of powers to the central government without any powers going to it which are not enumerated specifically (no regard to the general welfare preamble which needs removel), per capita taxing without regard to “progressive”, one six year term for a president who has a demonstrateable birth on US soil, return of senate elections to the state houses, voting for national office to only be granted to native born citizens and immigration control.

I think I see a flaw in the plan: The GOP cannot communicate effectively to the masses. With Boehner and McConnell in the lead, what chance they could ever rally the American masses?

Thanks for the link. I read that it was the first presidential film with sound recording. Telling. Common sense was in abundance back then. We are now governed by educated idiots.

He’s already breached the Constitution several times over. Congress either doesn’t care or has no balls (or both) to call him on it.

If he suspends the constitution, he should be immediately arrested. And, we should immediately stop paying federal taxes of any sort.

“One thing I will not compromise over is whether or not Congress should pay the tab for a bill they’ve already racked up,” Obama said in his weekly address. “If Congress refuses to give the United States the ability to pay its bills on time, the consequences for the entire global economy could be catastrophic. The last time Congress threatened this course of action, our entire economy suffered for it. Our families and our businesses cannot afford that dangerous game again.”

He allowed them to secede in full accordance with the U.S. Constitution.

Regrettably, Lincoln had to invoke Article 1 Section 8 of the U.S. Constitution after they did so.

And I’m no fan of Lincoln.
