So did Somalia give approval for Team 6 to extract two hostages at the beginning of the year? Obama was telling Panetta good job for that extraction while on camera during the State of the Union.

If it was not a consulate, then it was not sovereign United States territory. This fact has important legal consequences -- as was only just touched upon (at ~13:00, but pick up at ~10:00 for full context) by Newt Gingrich on Fox News in his appearance on Greta Van Susteren's Oct. 30 show An American CIC would have gone in and worried about feelings later.

If the administration is willing to admit that and disavow the facilities as part of the State Dept.'s diplomatic mission they could make that argument. They would have to explain why all the requests for improved security were going to the State Dept.
But how would they make that case for the personnel? I presume that ambassador Stevens and all the rest were there with the knowledge and permission of the provisional gov of Libya. Wouldn't we have the 'right under international law' to defend officials of the U.S. gov who were present in the country with Libyan approval?

Then the Brits, Italians, French, USA, Qatar, other’s equally violated Libyan air space during the NATO operations last year. The Russians and Chinese did not give the thumbs up, within the five permanent members of the Security Council.

We were trained to jump from commercial airliners because they are ubiquitous and nonattributable. It is one thing to prohibit American military aircraft from flying over your country. It is quite another to close down your airspace to all commercial traffic. Libya, Syria, Cuba, and a host of other thug nations allow commercial flights to fly through their airspace. This is all the opening a SEAL Team needs. Unknown and unseen, a SEAL element can parachute into any place on earth.One might insert: that is, provided one survives the jump. The trick is to exit in correct body position and deploy your parachute after the appropriate delay. There are two principal types of SEAL parachute operations: HALO, or high altitude, low opening; and HAHO, high altitude, high opening.

Syria with all of the Civilian casualities would likely be construed to be under that....
Now would Gun Running to the Rebels be covered....
I think there are some UN resolutions on Syria.....
