The short answer is NO!

They can talk about it, they can pass laws. They might even get the states to go along with it.

However the Constitution does not say the first Tuesday of November “weather permitting”

It also does not say “early voting is allowed” but that’s a whole nother can of worms.

Sandy is heading in via Joisey...Chris Christie will either chase the storm back out to sea (yes, he has the girth to do that) or arrange for every citizen’s vote to be counted manually.

A category I hurricane postponing an election? That’s something even a world war and a civil war couldn’t do.

If this Hurricane was hitting Texas, Mississippi and Alabama—all red states- would their be any discussion about postponing the election? Probably not.

Could America ever delay a presidential election due to a natural event or other catastrophe?

Hey Andy, you wish.

If Obama announces temporary emergency funds for 50 million Americans in the path of the storm, would he not get easily re-elected?

> Could a Hurricane Like Sandy Postpone the Presidential Election?

Probably if it looks like the dictator is going to lose.

Obama’s voters can’t vote - its all Sandy’s fault!

So the MSM seriously considers canceling the election. Look how far we have come!

These people live in another universe altogether. Acts Of God, its all political theater to them.

Another pretext for depriving us of our freedoms. That’s who the Left is - these people are in serious need of mental help!

Life’s tough.

Why not post pone the electoral college balloting?

Or, change the date of transition from January 20th to whenever the Cherry Blossoms bloom?

This is going to be a huge disaster, epic in fact but, life goes on apace.

The Constitution requires that electors vote on the same day. The Constitution does NOT require that electors be selected on the same day. The method of selecting electors is left up to the legislatures of each of the states.

By statute, Congress has mandated that each state select its electors (by whatever method each state chooses) on the Tuesday following the first Monday in November. The statue also provides that if a state is unable to select its electors on that date, then the state legislature can select the electors on a subsequent date.

So if a hurricane or other disaster hits on election day, then the affected states are free to cancel or postpone their elections without affecting the elections in any other state.

If the election was tomorrow it’s a talking point, but it’s a week away. And this is another argument against early voting. We did fine with absentee ballots to handle those not in their local on election day.

I do not have a problem with the storm being blamed on a lower voter turnout in New York, Baltimore, DC, Atlantic City, New Jersey and N. Virginia.

Hell, if I had to guess, based on the weather, I’d say this is proof that God is a republican.

(I am joking of course) I do hope everyone will be ok and my prayers are with those affected.

You mean like we suspended the 2008 campaign when financial Armageddon was bearing down on us?

This is what’s called bargaining. Actually, the Democrats are going through four out of Kubler-Ross’ five stages at the same time. (Acceptance is probably beyond them.)

RE:”The Constitution gives the authority to Congress to set the day when the presidential electors are chosen, and when the electors should meet to elect a president. Since 1845, all states choose electors on the same day — Tuesday after the first Monday in November (November 6 this year). And electors in every state meet on the first Monday after the second Wednesday in December (December 17 this year). Congress also enacted a Plan B: If a state fails to choose its electors on Election Day, the state has the authority to do so subsequently.....
If this actually occurred, Congress has the authority to change the date. As a practical matter, it would have to be a bipartisan effort. And there would need to near unanimity among the states, especially since many of them have non-federal elections scheduled for the same day. So, as a legal matter it is fairly easy. As a political and logistical matter, there are many complicating issues.”

There is no reason why lib eastern coast states like Maryland (my state) cant hold the election a week from tomorrow, lib gov O Malley may have to give up some of his early voting due to this boo-hoo-hoo.

It is not clear from above. What if a state like Maryland doesn't actually hold an election by Nov 6? They just choose their own electors? In this case I would prefer that. IF the Dems in Maryland general assembly and lib gov Malley gave them to Obama directly rather than this farce of a state election it would make my day.

Our first black Santa Claus Obama says he will refund states any extra election costs for early voting dues to this storm. Wadda a guy, wadda Santa.

You think you hate O? That is nothing compared to what I feel for gov O Malley.

This is yet another reason why the Electoral College method of electing the President is such a brilliant idea, one I hadn’t thought of before. Because if a natural calamity affects an area the size of a state, or several states together, they still do not lose any representation in the Electoral College, even if their turnout is lowered due to said natural calamity.
