NEAR LA JOYA — A Texas Department of Public Safety sharpshooter opened fire on an evading vehicle loaded with suspected illegal immigrants, leaving at least two people dead.

A Texas Parks and Wildlife Department game warden attempted to pull over a vehicle suspected of smuggling immigrants Thursday afternoon along Farm-to-Market Road 2221.

A DPS helicopter was called in to assist in the pursuit and a sharpshooter opened fire on the evading vehicle — a policy permitted by the agency.

Once the smuggler's vehicle stopped along FM 2221 near Mile 7 Road, troopers found three people shot inside, DPS spokeswoman Katherine Cesinger said in a statement.

Posse comitatus dos not apply to the USMC and it it possoble it also does not apply to the USAF, though I’m unsure.

I personally don’t consider military patrolling the border to be a violation of Posse Comitatus. I fail to see how its taking on police duties when the feds have a mandate to protect the borders anyway.

It's not Art 4, Sec 4 is clear that the federal government has a responsibility to protect the States from invasion.

The Coasties patrol the Detroit river and nobody considers it to be a violation. In fact much of what they do is the same as police do on land.

This is however, a DPS helicopter... which, IIRC, is a LEO-agency, not military. (Which only illustrates the militarization of the police.)

I’d rather have the actual military on the border than an increasingly militarized police force.

My mom’s uncle was flying border patrol out of El Paso Tx in the 1930s.

Typical liberal kneejerk reaction.

Stay there - don’t move here.

Depending upon the details, once I knew they weren’t talking about helicopter-mounted weapons I wasn’t much concerned.

Unless there had been shooting from the vehicle, this is a abhorrent act.

I am ashamed that so many FReepers do not share this view. Hopefully, many have simply forgotten to include the '/s' at the end of their post.

How many teens try to get away from the cops to avoid a ticket? I did, more than once, my son did, and many of my friends . Should we have been subject to summary execution?

Spare me your platitudes about eliminating dangers to the other drivers who may be on the road.

If you value freedom, consider what a seismic shift toward government control this would lead to.

The agency's director has said it's been forced into the role because federal agencies aren't doing enough to secure the border and because smugglers have become more aggressive, resorting to splashdowns, using other vehicles to block pursuit and throwing homemade spikes at officers.

This seems like one of those ‘SHTF’ stories. This is an international incident and it will probably draw Mexico and Obama into the picture before it’s all over.

besides details severely missing so are bullet holes with an intended non answer as the article ends.....meanin if bullets from the chopper killed any hole entries would lead the story....also oddly not know is were shots fired at ground level.....the story allows that if no chopper holes....then dem bullets came from somewhere

Wow. This is going to knock Libya off the news. Your article says the illegals were unarmed and on a farm-to-market road which generally means it wouldn’t have much traffic in Texas.

I could be wrong, but I assumed the shot illegals were in the bed of the pickup rather than the cab.

And how is this not murder?

in liberal California probably would be,in Sovereign State of Texas not so much a homeowner can shoot you for stealing from them on their property...remember they have a fast lane to Old sparky where california takes 20 years...

Recently here in my hometown on the Jersey Shore(not the tv show) a middle-aged woman, a wife, mother and grandmother was killed in a head-on collision by car driven by a drunken illegal alien from Mexico. How is that not murder? Count me as an American beyond fed up with Mexicans invading and destroying my country.

Amen! To those that have a problem with this, you obviously aren’t a Texan. We are tired of being overrun, tired of the sanctuary cities, tired of spending more money on ESL classes than regular education, tired of seeing seeing illegals flying and saluting the Mexican flag and not the U.S. flag, tired of all the money going to illegals for food stamps, welfare and Medicaid insurance so they can crank out more babies, tired of all the drugs coming across the border from Mexico and Central America. We’re tired of the Federal government not enforcing the laws of our land. One of the ESL teachers in the Dallas school system told another teacher that Mexico is taking Texas back one baby at a time. Enough is enough.
