A Hercules teacher who left his car running in a school parking lot Wednesday was arrested on suspicion of possessing marijuana for sale, after an inquisitive police officer checked out the idling Honda and found $4,200 in cash and suspected drugs inside, authorities said.
Police said the officer found the car idling in the parking lot of Hercules Middle/High School on Refugio Valley Road at about 8:45 a.m. Wednesday.
The car had temporary paper plates, so the officer ran its vehicle identification number to find the owner. While searching the glove compartment to find other identifying information, the officer discovered two plastic bags, one containing suspected marijuana and the other holding four rolls of cash totaling $4,200, police said.
Officers later found more marijuana in a large bag in the trunk, police said.

Arresting Officer: No, I mean your DRIVER’S license.

[gets license with great difficulty]

Arresting Officer: [after dirty look, of course] Sir, what’s your name?
Pedro: uuhhh... Isn’t in on the license, man? Yeah, that’s it! Pedro De Pacas, man, that’s my name...
Doubt the evidence will stick.
Hell, he was just trying to earn a little extra income man. If taxes were raised he would not have to have a second job.

Not a Chance, His Job is Absolutely Secure, you cannot even FIRE a convicted child molester if he/she is a Teacher with Tenure, the last one had to be “Bought out” by the union, $50,000 plus Full Retirement, this was a year or two ago in Los Angeles

Sounds like a good case for dismissal because of an illegal search.
Are you aware of any case law that would apply? The circumstances could make the search legal.
Since it’s illegal, at least in MD, to leave a car running and unattended, I could see a case made for probable cause.
