Military Employed For Crowd Control At College Football Game

In yet another example of the blurring of the lines between civilian police and US military forces, Columbia, South Carolina police “officials” have announced that US Military Police from Ft. Jackson will be on the streets alongside civilian law enforcement after the South Carolina-Georgia football game this Saturday night, October 6. According to reports by WISTV, Columbia will be spending more than $11,000 worth of overtime for 50 officers who will be placed in the Five Points and Vista areas after the game. The teams will be made up of University of South Carolina Campus Police, Richland County Sheriff’s Deputies, the South Carolina Highway Patrol, and Military Police from Ft. Jackson. The plan will involve barricades, surveillance cameras, DUI checkpoints, and even observation towers “to keep the crowd under control.”

Yes it is against the law. But then again, since when have the law applied to the rulers? Time is short.

I suspect you are thinking of the "posse comitatus" act, much beloved by freepers. The act does not prohibit use of Army troops for domestic law enforcement, if authorized by Congress. Laws passed since 9/11 make these issues more ambiguous. I recall flying soon enough after 9/11 to see active duty troops at the airport. No one complained about violation of the law then.

If the MP's are just standing by in case a soldier needs to be taken into custody, which appears from the article to be the enabling mission explanation, it is doubtful that that would violate the law.

btw, little known, Marines are not covered under posse comitatus, nor are National Guard units.

Incorrect. From the article:

Unfortunately, the placement of military soldiers in civilian law enforcement capacity is not only a violation of the Posse Comitatus Act of 1878, it is now an increasingly common occurrence.

Just a few years ago a mass murder happened in Alabama involving multiple crime scenes. The sheriff having only 1 deputy asking for help from the local military base to secure the sights. Later it was ruled by the courts to have been an illegal act.

I believe that Posse Comitatus does not apply to the USMC and it MIGHT not apply to the USAF.

Great response. No one said anything when my Marine battalion (2nd Bn 9th Marines) went into L.A. during the Rodney King riots. Between us and the National Guard, the B.S. stopped instantly. At no time did the military TAKE OVER civilian control: we were asked for by the Governor.

Posse Comitatus is not absolute, and there are benefits on both sides of the limiting factors in its use.

Courts have ruled otherwise. The National Guard is now part of the US Military. They no longer report to the Governor of their state.

Military police have no civilian jurisdiction. Any arrests of civilians by military personnel not within the precincts of a US military compound would be weightless, and the arrestee could sue prosecute for wrongful detention.

No, but there is a DoD regulation that prevents the Marine Corps and Navy from being used without civilian authority. The Marine Corps cannot be used willy-nilly just because it isn’t mentioned in the Posse Comitatus Act.
