Lockheed accepts Obama’s ‘guidance’ and will delay sending layoff notices until after election

As we discussed on Saturday, the Obama administration has offered to cover expenses (court-ordered penalties, severence costs, etc) for contractors willing to ignore the WARN Act by delaying sending layoff notices to tens of thousands of their employees who will likely be hit by Pentagon budget cuts.

Do it soon. The longer they have to contemplate the legal ramifications of deliberately conspiring to break Federal Law and the possibility of individual, personal penalties including significant prison time, the better the odds they will decide to follow the law and notify their employees.

Sure, just like they covered the costs of all those campaign visits to cities around the country ... I can't remember how many cities got stiffed on security, overtime, etc... costs because Zero wants to blow in for a few hours.

legal folks there. They worked with ITAR and exports.
I’m retired now, but still have a few contacts.

Lockheed has no exposure (as far as their legal department is concerned). IF Obama keeps his word, the taxpayers will fully cover any expenses.

I am not sure. An agreement to violate the law is unenforceable. So if Lockheed takes this deal, gets sued and loses, the federal government would not have to keep its promise to reimburse fines, penalties, etc. If Romney wins, we could expect that Lockheed would be out of luck. In the unlikely event Obama wins, it may be that a taxpayer would have standing to sue to block enforcement of this agreement. I sure don't want my tax dollars used for this.

As another poster also suggested, this agreement may not only be unenforceable, but also illegal.

No mere citizen has standing in court. That was very thoroughly demonstrated every time a mere citizen tried to get a court, any court, to verify obama's alledged status as a Natural Born Citizen.

I share your disgust with the legal system. However, there is a difference between a "citizen" and a "taxpayer." Moreover, "standing" depends on the legal question at issue.

Another thought occurs to me, and that is that Congress should legislate that no federal monies be spent to comply with this agreement; meaning, it is important to win the Senate as well as the Presidency.

On the other hand, until they announce which programs are cut, and until they can be sure Obama isn’t going to win, what contractor is going to go against them? Obama has shown that he will use the naked power of government against his enemies.

Seems like if you don’t want your programs to be the ones on the chopping block, you better take the bribe and keep quiet.
