I’m being mundanely realist here. It’s going to get bumped up to the USSC if anyone tries to put a legal lid on it. And we know from history what the USSC has always said. It’s one of the small set of things on which the liberal and conservative wings have virtually unanimously agreed on. So I can see no point at raising any legal howl at that particular moon. Surely the victims of the 9/11 bombings were in the same situation, yet nobody called for censoring videos about them and nobody is going around today interviewing them about the agony they experience every time someone says airplane or boxcutter.

That being said, I’d hope there would be a popular push for any such media to be respectful to those who perished or were badly wounded. That the market, not the law, would punish what was overly exploitative.

I’ll be those 09/11 families have been hounded far more than we know.
