Breitbart News spoke to James Michael Holmes, the Tea Party member falsely identified this morning by ABC News' Brian Ross and George Stephanopoulos on Good Morning America as the possible suspect in the mass shooting early this morning at a screening of the new Batman movie, The Dark Knight Rises. He is a 52-year-old Hispanic conservative who joined the Tea Party after becoming disillusioned with the Republican party.
"It was freaky," said Holmes, describing his reaction when ABC News speculated that he was the culprit who entered a crowded theater and opened fire on dozens of innocent men, women, and children. He disconnected his telephone and says that he is worried about members of his family who might be contacted by the media.
ABC News has since corrected its initial report, but tried to share the blame with "social media" and "members of the public" at first:
An earlier ABC News broadcast report suggested that a Jim Holmes of a Colorado Tea Party organization might be the suspect, but that report was incorrect. Several other local residents with similar names were also contacted via social media by members of the public who mistook them for the suspect.
Now the correction has been updated, with ABC News and Brian Ross taking full responsibility, and apologizing:

should be FIRED for telling falsehoods. Isn’t slandering someone without any substantial PROOF cause for a lawsuit against these two and network they work for?

He has to show damage. The other two main elements of slander (falsehood and insufficient attempt to prove the initial statement was true) have already been met.
Since Mr. Holmes is not a public figure (or was not before today), the standard to prove slander is much lower than it would be for a public figure (no ‘actual malice’ test applies here from what I have read).
Its money comes from deluded corporations through ad revenues, it then turns around and gives the Left free air time and carries its message without charge.

It essentially would depend on what a jury believes a man’s reputation and honor is worth and how much they have been damaged. Juries tend to be overly generous.
What if someone took a shot at him, how much would that be worth?
My guess (and it’s only a guess) would be that he could show damage through receiving a threat or an adverse reaction to ABC’s horrible reporting through other means.
Point being, he’s got a lot shorter road than a politician should he decide he wants to own ABC News.
And it will take someone who has that mindset to eventually get the nonsense we’re seeing from left wing media to stop.

Using Intelius and google it took me all of two minutes to discover that there were at least 8 James Holmes in Aurora and find the Tea Party page and see that that Jim Holmes intends to see Brigitte Gabriel next Thursday. Two minutesand these partisan hacks Steffi and Ross wouldn’t take two minutes to verify their info.And Ross had already been on line, only his google search went this way...

While this guy has a HUGE lawsuit in my opinion, he also needs to watch out. The sleazy media (duplicate, my bad) will be after HIM like they went after Plumber Joe. They will be dragging his name through the mud if they can, looking up any debts, disgruntled neighbors, etc. Heck, Gloria Allred may be called in to find some hapless woman that he made “uncomfortable” in order to deflect the attention away from the out-of-control ba$tards in the media. He needs to get an attorney and quick!
Penalize ABC. TAX them! $ 1 million a pop everytime they have to apologize for doing something like this. Period. $1 million for each apology,,that may just get their attention. THEN sue the hell out of them!
So ABC admits they did not properly vett the story,,so sue them and make it clear that all monies will go to the Tea Party,,and then,,,the Tea Party in CO should sue ABC and have all those proceeds go to the Tea Party. Wow,,,a little cash infusion for the Tea Party courtesy of ABC!

Last nights mass murder in a Colorado theater, without a doubt, is a horrific and unspeakable tragedy. However, as much as I grieve for the victims, their families, I refuse to blame an inanimate object guns rather than the actual lawbreaker James Holmes. Liberals live to shamelessly politicize such tragedies case and point, immediately blaming the Tea Party hoping our Second Amendment rights will be stripped away by whipping public anger into a vacuum of mass hysteria. These same constitutional terrorists, who cant keep drugs off the streets, let alone out of our schools, would leave us at the mercy of thugs and lowlife opportunists, not to mention vulnerable to government tyranny; Thomas Jeffersons most profound reason for defending our right to bear arms. In essence, gun control is the final lynch pin in the lefts ultimate goal of uncontested subjugation.
The real tragedy in this endless debate is that the media never reports how times firearms save lives, feed families, foil crimes, and guard freedom around the globe. I could not imagine lying awake at night, knowing my family was at the mercy of some deranged intruder while I was powerless to protect them. Im an American, a patriot, a law abiding citizen, and theres a reason why I keep a Glock 20/10mm beside my bed at night: I refuse to be a statistic. And just in case you want one, over 50 million gun owners did not commit a crime last night. You do the math.
