Romney has not been nominated, how can he (legally) pick a VP before the convention?

It’s that old aura of inevitability thing that the left uses so frequently.
That says to me there is concern that it’s not exactly in the bag at the convention.
VPs are almost always picked before the convention. Usually it's the weekend before the convention. Sarah Palin was announced by McCain on Friday, August 29, 2008. Convention did not begin until Monday, September 1.

So what? He can pick someone even if he weren't running. Is there a law against choosing a running mate in an election?
