I ran into a prominent conservative member of Congress Friday night just before the huge storms moved through Washington. He was, he said, far angrier on the day after the Supreme Court Obamacare decision than he had been the moment he learned Chief Justice John Roberts had joined the Courts liberal bloc to uphold the individual mandate at the heart of Obamacare. He didnt resort to histrionics or profanity, but he was spitting mad and his anger was growing, not diminishing.
A short time later, I saw another conservative lawmaker who said much the same thing. And yet another conservative leader who was in the same frame of mind.
At the same time, a backlash was forming in response to analyses by some formidable conservative writers George Will, Charles Krauthammer, and others who argued the Obamacare decision was actually a victory for conservatives because it placed a limit on expansive interpretations of the Constitutions Commerce Clause. In the Wall Street Journal, Berkeley law professor and former Bush Justice Department official John Yoo called such silver-lining analyses hollow hope and wrote that Obamacare is precisely the disaster for conservatives it appears to be

In talking to a lot of friends, I can assure you the RAGE is real and not just among Conservatives. The will of the American people has been defied by politicians who want the power to decide who lives and who dies. In my opinion, we are now living in Nazi Germany II where government Death Panels will decide your fate based on their criteria. Never doubt that they can and will use Death Panels as a means to eliminate whomever they think are their political enemies. No one I talk to doubts that now. Death Panels thanks to Obama, Pelosi, Reid, et al. is the coming Gestapo.
2010 - When we take the House, the first and only job will be to turn back ObamaCare...
2012 - When we take the White House and the Senate, the first and only job will be to turn back ObamaCare...
Same song, different chorus. More than a few golden opportunities have presented themselves to overturn ObamaCare, most notably the spending cap increase - ‘You want to spend the nation into debt, ObamaCare goes into the trash can.’
Heck, 100 watt incandescent light bulbs are STILL illegal to sell - we’re just told that since there’s no money allocated to enforcing it, this is a win. I want the government OUT of my life, not cuddled up next to me in bed with promises it won’t snore.
Congress can now do the job it promised in 2010 - repeal ObamaCare.
We cannot accept this or let it slide as a loss that is now in the past. We have to fight ObamaCare at the polls in the presidential election, in voting for conservatives or at least republicans to dominate the US House and Senate, in state elections so our governors and state legislators will resist ObamaCare. We have to fight ObamaCare in filing more lawsuits in state and federal court, in firing workers to get below the 50 employee limit or at least refusing to hire and rise above that limit, and in all other respects resisting ObamaCare as we would resist any other form of national socialist, soviet socialist, or other totalitarian socialist grab for power over our lives. We have to fight ObamaCare as if our lives depended on victory - because it is our lives and our children’s liberty that are at stake in this latest battle between freedom and slavery.
The Honorable Chief Justice just called it what it is. Not a penalty enforced, by the way, by the IRS, but a TAX enforced by the IRS.
The Democrats tried to avoid this when they wrote the bill by striking out the ‘tax’ reference and putting in ‘fee’ in it’s place. Roberts just did not let them get away with it.
So, yes, if the Congress wants to tax the people to provide socialized medicine, they can, since they are elected by the people to make tax laws. Roberts is right because that taxing authority is Constitutional. Don’t like it? Vote them out!
Not really. It should require a constitutional amendment to make it legal.
Certainly they have the power to do so, but a certain Obama veto trumps that power. Since the Senate as currently constituted would never repeal, it makes little sense for the House to move forward on its own and risk the loss of any seats in November. Choose a battle that can be won, and then use the win to secure victory.
Friday morning, following the ruling, we had our scheduled County Republican Breakfast, with Congressional and State leaders in attendance.
It was a very invigorated and motivated crowd.
We too had a few libertarians express: This conservative is absolutely livid. Part of my anger is directed at Republican Party, which gave us Roberts.
Why do people believe there is some cabal capable of seeing the future rulings of a Justice?
Their charges suggest some master plan, mapped out for implementation irrespective of who is in office.

Well good. Welcome to my world. I too am angrier the more I digest Robert’s tortured opinion. The guy is world class mental gymnast to twist the constitution around to rationalizing the the penalty for not buying Deathcare is a tax. What a load of BS.
The dissenting opinion spells the whole thing out perfectly. Obamacare is unconstitutional in its horrendous entirety.
The last best hope is to win in November, take the Senate decisively (because I believe there will be RINO defections like Murkowski) and repeal Obamacare on Day 1.
I don’t think the “backlash” against conservative punditry is warranted *IF* the conservative political class can translate the language of the SCOTUS opinion into victory come January 2013.
The battle will be to convince both Democrat and Republican voters that ObamaCare will be a disaster that will destroy not only our economy but our medical system. It would help if someone could explain how this obamanation will affect every American. I don't have the time to read and parse its 2000 pages. Does anyone know of a good list of talking points that could be used to make your average TV addict pay attention?
IIRC, the House did vote on repealing Obamacare...knowing it would be ignored by Harry Reid’s senate.
