By placing the ACA under the umbrella of the tax power, Roberts may have made the ACA easier to overturn by several orders of magnitude. The ordinary process, of course, requires 60 votes to overcome a filibuster in the Senate. But when it concerns budgetary matters, including taxes (like the Bush tax cuts), 51 votes are sufficient to put the law on hold for 10 years. So, theoretically, 51 Republicans will be capable now of overturning the ACA at least for ten years (at which point it could be reviewed again). Fifty-one Republicans could have attempted this in any case, but now they can do so with much greater plausibility because this is a matter of taxing and spending and not regulation of commerce.

You’re assuming we’ll have 51 votes in the Senate after the election. Not just 51 Republican Senators but 51 willing to vote it down.
51 conservative constructionist votes, not just 51 Republican votes.
If we cannot find and elect 51 conservative senators then we deserve no more than we get. Sad but true.
The fastest way to repeal this is to go after the wavers. HHS can’t wave taxes and if the Republicans insist that everyone pay “their fair share”, it won’t take long for it to be repealed.

Huh? There will be many more lawsuits coming and it’s always possible the SCOTUS reverse itself on many aspects of Obamacare, NOW THAT IT’S OFFICIALLY A TAX. Obama’s 1,200 hand picked Waivers without approval from Congress, for one. I would love to see 1,200 Obama-buddy companies have to stick Obamacare up their a** and live with it.

This bill was passed by reconciliation...it can be repealed by reconciliation.

There are an awful lot of “if’s” out there. If Romney wins, if we capture the Senate, and “if” that combo actually act to repeal Obamacare. It’s an issue now, but come January they might all see it differently.
Obamacare has to be replaced with something. The current system is absolutely destructive and cannot continue. But, the same bunch of slugs couldn’t even end the sugar subsidy.
It will take at least 60 votes to override the ‘rat filibuster.
He could have done all the article says, and he could have struck it down at the same time.
