Otherwise, why will the "penalty" be paid to the IRS or, alternatively, collected from your IRS tax refund if it is NOT a tax!!??

How so? Is it an excise? Is it an impost? Is it apportioned? Is it a tax on income?
Those are the taxes Congress is allowed to impose. If it's none of those, it ain't constitutional.
When someone looks you in the eye like this and states boldly an obvious lie, they are either calling you too stupid to know it or too weak to call them on it. Yes, elections have consequences, but words have meanings, especially in the law.
Unfortunately, it is a brilliant political move. The white house refuses to call it a tax, but the SCOTUS calls it a tax. Zer0bama gets to move forward on it, continue to stuff it down our throats, and never has to call it a tax. A rose by any other name would smell as sweet, and a tax by any other name smells just as sweet to the democraps.
