The Justice Department moved Friday to shield Attorney General Eric Holder from prosecution after the House voted to hold him in contempt of Congress.
The contempt vote technically opens the door for the House to call on the U.S. attorney for the District of Columbia to bring the case against Holder before a grand jury. But because U.S. Attorney Ronald Machen works for Holder and because President Obama has already asserted executive privilege over the documents in question, it was expected Holder's Justice Department would not take that step.
Deputy Attorney General James Cole confirmed in a letter to House Speaker John Boehner that the department in fact would not pursue prosecution. The attorney general's withholding of documents pertaining to Operation Fast and Furious, he wrote, "does not constitute a crime."

There are oaths of some sort sworn by all law enforcement officials that they will uphold the law and specifically oaths sworn by Federal Employees and officers of the military to defend and protect the Constitution against all enemies foreign and domestic. It is part of the United States Code. As of today, I dont think it means anything anymore.

Title 5 Part III Subpart B Chapter 33 Subchapter II § 3331
The oath taken by officers does not include any provision to obey orders; while enlisted personnel are bound by the Uniform Code of Military Justice to obey lawful orders, officers in the service of the United States are bound by this oath to disobey any order that violates the Constitution of the United States.

This section does not affect other oaths required by law.
Funny, nobody has moved (formally) to prosecute him.

Does Congress take an oath of office? They passed a law that was unconstitutional.

And the House always has the option to arrest Holder directly, but this hasnt been done in 80 years, there is no longer a Congressional jail and a stand-off between the House Sgt-at-arms and the FBI wouldnt be pretty.
