White House Statement on Obamacare Mandate Tax Contradicts Supreme Court Ruling By Matt Cover June 29, 2012 March, 7, 2011.

(CNSNews.com) – The White House said Friday that the Obamacare insurance mandate tax is a penalty for not having insurance – a statement that directly contradicts what the Supreme Court ruled Thursday.

According to press reports, White House spokesman Jay Carney told reporters aboard Air Force One that the penalty was not a tax but a penalty.

“It's a penalty, because you have a choice. You don't have a choice to pay your taxes, right,” Carney is quoted as saying by Yahoo News.

In a 5-4 ruling issued just one day before, Chief Justice John Roberts stated that the mandate was not a penalty and was, in fact, a tax.

“The Affordable Care Act's requirement that certain individuals pay a financial penalty for not obtaining health insurance may reasonably be characterized as a tax,” Roberts wrote.

Roberts said that the mandate “makes going without insurance just another thing the government taxes, like buying gasoline or earning an income.”

Nevertheless, Carney said that it was not a “broad-based tax,” arguing that few Americans will pay it.

So why is the GOP and Romney not standing at Robert’s door demanding injunctive relief?

This is the official position of the people that wrote it so it’s unconstitutional. The fact they let these statements under color of authority slide is why no one has any faith in the GOP or Govt., period.

If its unconstitutional its not a tax, if its constitutional its a tax.

You cannot pick and choose that.

Oh, the Dems understand all right, but don’t want anyone to mention the fact that they passed the largest tax in the history of the world on every American during the “worst recession since the Great Depression.”

Every ad by the GOP in this election season ought to hammer home that fact, as ruled by the Libs’ beloved Supreme Court justices and one nutty professor appointed by Bush.

Audacity! If you are a Democrat, and it has been proven time and again you have the choice. The Democrat will choose to NOT pay their taxes many times over.

Don’t kid yourself.Obama knows full well he has less than 5 months to convince the public that this tax is not a tax. If it stands in the people mind as a tax, which is what every Republican should be calling this every chance they get, his re-election chances go way down.

Example followup for my post #6 would be Tim Geithner the Obama Sec. of Treasury, Tom Daschle the original nominee for HHS, and who else...Rangel, and many others have been exposed for their non payment of taxes we the sheeple have no choice but to pay, OR END UP IN THE HOOSEGOW, and lose everything if we don’t.

Democrats of political favoritism, and crony’s get away with it.

Gee, Mr. Carney. If I choose to not pay my taxes owed am I not assessed a PENALTY, (and interest), by the very same IRS that will be levying this one? Idiot.

How about the fact that companies across the country have spent tens of millions on a fraudulent law? Seems strange that being defrauded under the formentioned color of authority is a felony and that money HAS been spent/persons/companies have already been damaged.

It just seems nuts to me that a lot of the obvious tracks haven’t even been discussed.

Not according to the numerous law dictionaries I have consulted. Being taxed for not buying something you don’t want is not included in any definition currently published. Guess we need a law dictionary update.

Obviously Roberts was going to push this thing thru by any tactic he could come up with...

We pay taxes on gas that we buy...We pay taxes on income we earn...And now, we pay taxes as well on nothing...

We do not by health insurance but we are taxed on it...If we buy it, we don't pay the tax...

Uh, why not do that with gasoline???

I vote to impeach Roberts...
