After extensive research, I found a precedent in medieval English law that makes about as much sense as Chief Justice Robert's decision. I have taken the liberty of applying Robert's logic to that historical narrative for that case:
CROWD: Obamacare! Obamacare! We've got Obamacare!
VILLAGER #1: We have Obamacare, can we uphold it?
CROWD: Uphold it! Uphold it!
BEDEMIR: How do you know its Constitutional?
VILLAGER #2: Because Pelosi said so?.
BEDEMIR: Bring it forward.
WITCH: I'm not a tax. I'm a mandate.
BEDEMIR: But you are dressed as a tax.
WITCH: They dressed me up like this.
VILLAGER #2 Uphold it anyway!
CROWD: Uphold it! Uphold it!
BEDEMIR: Quiet, quiet. Quiet! There are ways of telling whether she is a tax.
CROWD: Are there? What are they?
BEDEMIR: Tell me, what do you do with taxes?
VILLAGER #2: Raise them!
CROWD: Raise raise them up!
BEDEMIR: So, how do we tell whether she is a tax?
VILLAGER #1: Watch CNN?
BEDEMIR: If it quacks like a duck and walks like a duck? Then it is
ARTHUR: A duck.
CROWD: Oooh.
BEDEMIR: Exactly! So, logically...,
VILLAGER #1: If... if she weighs as much as a duck...
BEDEMIR: And therefore--?
VILLAGER #1: A tax!
CROWD: A tax!
BEDEMIR: We shall use my larger scales!
[yelling]
BEDEMIR: Right, remove the supports!
[whop]
[creak]

CROWD: A tax! A tax!
WITCH: At least my case made it to the Supreme Court.
What? It is SCOTTISH law dammit!

All that has to be done is to have the Convention Delegates vote to ABSTAIN on the first ballot in Tampa.
This would DUMP Romney, and open the floor to nominate Newt, or we could do nothing and watch Romney lose by 10 % to Obama in November.
