Chief Justice John G. Roberts is an evil genius. The ruling to uphold the Affordable Care Act is, on its face, a win for President Obama both because the media are saying it is and because it is the signature piece of legislation of his first term. But it may turn out to be a pyrrhic victory, as Roberts accomplished numerous, subtle victories for conservative Republicans.

In Virginia, and I think other states as well, you are assessed a fee if you don’t have car insurance. Of course, that’s an inexact analogy, since you only have to make that choice if you have already chosen to own a car

We will see how big a genius he is a couple years from now, when the government mandates you install a solar cell system on your rooftop, from a short list of Obama approved suppliers, or pay a tax of $7,500.00.

Under this ruling the dems could pass a law that anyone with a Body Mass INdex over “X” will pay three times the obamacare “tax” than someone whose BMI is under “X”. Or they could pass a law that anyone spending less than “X” on brocolli in a year will pay three times the Obamacare tax. They can regulate any behavior they want by adding a massive “tax” for those who don’t comply.

For that matter, today's ruling paves the way for Milton Miteybad's pet policy proposal...the Federal Liberal Advocacy Income Levy Surtax, or FLAILS, for short. Vote for Democrats, and you are deemed to have volunteered for an additional 50% income surtax on top of your existing rate. Citizens who vote for Democrats in federal elections who are in the 28% bracket will have their marginal tax rate increased to 78%, for example.

This could be easily implemented using currently available technology, and it would offer the added bonus of compelling the proponents of liberalism to, at long last, start paying the bill they courageously foist on the rest of us.

This next session of Congress may be the one to take it up, since today's ruling is going to make incumbent Democrats a species nearing extinction on November 6. With favorable election results in November, it may be possible to pass this with a veto-proof majority as early as this time next year.

Obviously, if the federal government can extract a tax from you for the act of not buying insurance, then we can make voting for Democrats a taxable event. After all...anything can now be construed as a taxable event. Even breathing is without health insurance is now taxable.

FLAILS can now become a reality. Let's make it happen. ;-)

Where on earth does Roberts live? There can be no Independence Day celebration this year thanks to this black robed POS, but there sure as hell can be one humongous protest outside his home.

Here’s the problem with Slate’s theory, as well as everone else who thinks along similar lines: it’s predicated on the belief that a cobbled together five-justice majority to reign in the expansive use of the Commerce Clause under the precedent set in this decision is going to be a certainty going forward.

How old are Scalia and Kennedy again? How much longer can they be expected to serve? I figure both want to hang on and retire under a Republican President (I think Kennedy has even said that he plans to do so), but plans cease to matter in the event of a stroke or heart attack or cancer.

Considering that the Liberal Wing of the Court could care less about stare decisis, anything positive in Roberts opinion will be rendered moot if Obama gets a chance to replace Scalia or Kennedy.

Usually the car insurance is to cover the other guy and the other guy’s car, not you or your own car, unless you do not own your car outright and then you have to have insurance to cover what the bank would lose should your car get wrecked while you still owe for it. Also, this is reserved to the States.

It is not necessarily true that the Supreme Court has to be involved in this matter again. The Court has ruled on Obamacare as a tax. That’s clear. It’s now the ObamaTax. Now the Legislative branch is free to pass legislation changing or rescinding this ObamaTax...with a 50%+1 vote!

Rep Pete Stark was constitutionally wrong but right in reality when he said “the federal government can do anything it wants”.

These communist filth in our government need to be reputiated to the point that they will never stick their ugly faces out in public.

If those of us with right leanings regardless of degree, do not get on board and open our wallets and allot time to work to not only get conservatives, GOP, Tea Party people elected but just as important make sure the left loses each and every election by as big a margin as possible then we will have left these parasites with enough oxygen in their lungs to regenerate and return to “fundamentally change this country”

They must be destroyed at the ballot box. Help drive a stake dead center into the heart of liberalism.

For the first time since Ronald Reagan, I opened my wallet for the GOP and I opened it as wide as the law allowed. I challenge anyone with a love of the founders to do the same. Yeah, it might not be for your prime choice but right now in 2012 we only have 2 choices and sitting on the sidelines and hoping for change (sound familiar?) will leave us with the dark lord in charge and unencumbered by the polls to implement as many Marxist programs as possible.

The precedent is, the new deal era rulings. Remember social security was sold to the public as an insurance program. Sound familiar?

When it was challenged in court it was defended as a tax. Some exemptions were allowed, not many.

Under the “commerce clause” not doing something, is enough. Wickard vs. Filburn dealt with a wheat farmer who grew wheat for his own consumption or use. Since he _wasn’t_ buying commodities outside the state, this affected interstate commerce. See how easy that is?

Since this decision leaves even the IC clause behind, no idea what they are thinking.

The “government also makes people buy car insurance” is flawed in several ways.

Not because driving is voluntary, because the _insurance isn’t for the driver_ or his car, it’s liability insurance for anyone who might be harmed as a result of actions by the driver.

The analogy would work if auto insurance cost $9000 a year regardless of driving record, miles driven, age, etc, covered gas, oil, wipers and tires.

Mark Levin posted on Facebook that there is nothing good about the ruling. He might be overselling it or is too close to the case since his LankMark Legal Foundation working on arguments against ObamaCare for one of the cases.

I need to point out the Daily News repeats a lie about the time of the origin of the individual mandate.

It was the late 1980s and not simply a response to HillaryCare while that's where the concept became more visible.

The mandate, requiring every American to purchase health insurance, appeared in a 1989 published proposal by Stuart M. Butler of the conservative Heritage Foundation called "Assuring Affordable Health Care for All Americans," which included a provision to "mandate all households to obtain adequate insurance." Source
