Looking at this another way, if their agenda was to guarantee socialized medicine survives, the SCOTUS had no choice than to call this a tax.

Personally, I would rather they had taken the administration at its word, considered it a mandate and struck the whole mess down outright.

Look at the way the Supreme Court men in skirts reversed their decision on homosexuality.

The court CAN overrule an earlier decision (bad or not).
