WASHINGTON (Reuters) - A U.S. appeals court on Tuesday upheld the first-ever U.S. proposed rules governing heat-trapping greenhouse gases, clearing a path for sweeping regulations affecting vehicles, coal-burning power plants and other industrial facilities.
Handing a setback to industry and a victory to the Obama administration, the U.S. Court of Appeals for the District of Columbia unanimously ruled the Environmental Protection Agency's finding that carbon dioxide is a public danger and the decision to set limits for emissions from cars and light trucks were "neither arbitrary nor capricious."
The ruling, which addresses four separate lawsuits, upholds the underpinnings of the Obama administration's push to regulate carbon dioxide emissions, and is a rebuke to a major push by heavy industries including electric utilities, coal miners and states like Texas to block the EPA's path.
In the 82-page ruling, the three-judge panel also found that the EPA's interpretation of the Clean Air Act to regulate carbon dioxide regulations is "unambiguously correct."
The court also said it lacked jurisdiction to review the timing and scope of greenhouse gas rules that affect stationary sources like new coal-burning power plants and other large industrial sources.
EPA Administrator Lisa Jackson said the court found the agency "followed both the science and the law in taking common-sense, reasonable actions to address the very real threat of climate change by limiting greenhouse gas pollution from the largest sources."

As it should. Some conservatives are starting to sound like liberals. When we don’t like the law we want the SCOTUS to save us. Elections have consequences. Bush had the majority and could have gutted the EPA but didn’t. So they are free to use the law that was passed to regulate emissions. The Clean Air and Clean Water acts were brought to us by Republicans.

The regulations are based in total falsehood. The courts are a proper place to take up such things,but they are acting as a rubber stamp for global tyranny.
The primary purpose of the EPA is absolute government control, not protection of the environment
the court has no authority to grant legislative authority to the EPA
Greenhouse gasses protect the Earth, plants thrive on it, it keeps the earths temperatures stable
the EPA has no evidence whatsoever that CO2 is harmful, or what levels may be harmful the evidence supports that CO2 is beneficial in all quantities
Bush and the Republicans are in NO WAY even slightly conservative, in actual deed, they are merely slightly less liberal/socialist than Clinton or Obama
Jackson, a marxist protege of former EPA leader CArol Browner, another marxist, is full of shit.
There is no science that says that CO2 is a dangerous greenhouse gas. It is the twisting of science by the leftists and pseudoscientists (read, getting fat govt grants to promulgate their BS), that has created a “danger”.
Take away CO2 and you die because plants won’t be able to create oxygen, which we need.
This decision is a prime example of how our educational system has failed America, esp. over the past 50 years.
Time to fight back by joining conservative scientific groups who are fighting this voodo science.

I for one would like to toss the whole lot of them in a carbon-free, greenhouse gas=free environment for the remainder of their time. Let them ponder the folly of their assertions and subsequent actions.
Their remaining time would be very short.

Actually, trees are a C02 trapping mechanism. They do emit C02 at night, but they absorb more duriing the day than they emit at night.
To the fools that think we have a chance of getting our country back via the courts, not gonna happen. The courts will never roll back big government despotism.
The federal courts, including SCOTUS, don’t give a damn about the Constitution. And that is not going to change in our lifetimes.
1. CO2 is essential for all life because it is the main source of Carbon for ALL organic cells. All organic cells have CHON in them.
2. There is no know cause and effect between a change in temperature and CO2.
3. The most abundant “Green House Gas” is water vapor: 25,000 ppm vs < 400 ppm for CO2.
4. CO2 is an environmentally essential AND friendly green house gas.
