“United States v. Nixon” makes it pretty clear that “executive privilege” does not apply to information sought in criminal investigations of the executive branch.

That they waited so long to claim the privilege undermines its validity. They are stallllling. Soetoro would be the first President to not finish his first term alive if they can't get to November.
