An illegal immigrant applying for a law license in California should be allowed to receive it, the State Bar of California argues in a filing to the state Supreme Court.
Sergio Garcia, 35, of Chico, Calif., has met the rules for admission, including passing the bar exam and the moral character review, and his lack of legal status in the United States should not automatically disqualify him, the Committee of Bar Examiners said Monday.
Mr. Garcias status in the United States, should not, ipso facto, be grounds for excluding him from law licensure. He has met all of the prescribed qualifications and there is no reason to believe he cannot take the oath and faithfully uphold his duties as an attorney, the bar said.

Hell, every time you go before the judge to testify, you take the oath.

The first time his client won a case, it would immediately be appealed.
I guess the fact HE IS BREAKING THE LAW doesn’t enter into the decision.
/ I live in Chico. The majority of the residents tend towards being conservative. However, the CSU, Chico campus attracts a large population of extremely liberal outsiders who do all they can to meddle in local politics.
Question: Would not the fact this individual is in the U.S. illegally fall into the category of being covered by the "moral character review"??? Would not a violation of the Constitution of the United States be a failure of moral character? The world is upside down.
As an officer of the court, he’s supposed to uphold the laws of this country, not just the ones he likes.........
Wait a minute, In Maryland: the Act you cite asks for fingerprinting in order “to determine whether the applicant or member has a record of criminal conviction ... and in discovering prior and subsequent criminal arrests....” Isn’t that the crux of the matter? Someone can stand up and identify himself as an illegal alien, as someone who is in flagrant and constant violation of federal law — and he has so little fear of arrest (much less conviction) that he is willing to appear in court to demand his “rights.” All it would take to end this farce is a federal agent willing to arrest this person. The fact that this arrest — enforcement of the law when someone advertises his lawbreaking — almost certainly will not occur is what makes this absurdity possible.
Next, why not allow him to become a judge? Then he can complete his destruction of the Rule of Law by legislating pro-illegal interests from the bench.
Quite right. Silly me - still stuck back in an age when someone who publically admitted they were committing a crime was arrested. Very old-fashioned, I know.
