MONTGOMERY COUNTY, TX (CBS ATLANTA) -
An honor student in Texas was thrown in jail after she missed too many classes at her high school.
A judge issued Diane Tran, 17, a summons Wednesday for her excessive truancy after she missed class. She was arrested in open court.
Last month, Tran was issued a warning by the judge for missing school.
Tran said she works both full-time and part-time jobs, in addition to taking advanced and college level courses.
But the judge said Tran's case was bigger than the individual situation of one student.
"If you let one run loose, what are you gonna' do with the rest of 'em?," said Judge Lanny Moriarty. "Let them go too? A little stay in the jail for one night is not a death sentence."

According to Texas truancy law students can have no more than 10 unexcused absences - full days or part days - within six months, and no more than three absences within one month.
Texas Education Code 25.0951 states that:
If a student fails to attend school without excuse on ten or more days or parts of days within a six-month period in the same school year, the District shall within ten school days of the students tenth absence:
1. File a complaint against the student or the students parent or both in a county, justice, or municipal court for an offense under Education Code 25.093 or 25.094, as appropriate, or refer the student to a juvenile court in a county with a population of less than 100,000; or
2. Refer the student to a juvenile court for conduct indicating a need for supervision under Family Code 51.03(b)(2).

This is just one of those “hidden”secrets that those who crow about just how “good” Texas is don’t tell you about. Texas still allows schools to “administer” corporal punishment (that’s hitting your kid without your permission). Glad I don’t live there! The “sheriff” from the old Dodge commercials is still alive and well in Texas. Yo in a heap o trouble boy!
So he admitted that he was excessively punishing her. His sentence needs to be immediately vacated and he needs to be removed from the bench ASAP.

I don’t get all the posters on this thread calling the judge a socialist. He seems like the very model of a rules-first social conservative - the exact type who gives Republicans a bad name.
