SAN ANTONIO, April 26 (Reuters) - U.S. Transportation Secretary Ray LaHood called on Thursday for a federal law to ban talking on a cell phone or texting while driving any type of vehicle on any road in the country.

Tough federal legislation is the only way to deal with what he called a "national epidemic," he said at a distracted-driving summit in San Antonio, Texas, that drew doctors, advocates and government officials.

I don’t think people should be talking on their cell phones while driving or, heaven forbid, texting on the things and I am not averse to state laws against the practice. However, it is not a fit subject for FEDERAL legislation or rule-making. The Feds should in no way be passing laws against felonies and misdemeanors other than for exclusive federal jurisdiction, such as military bases. That is, in the system we wish we still had, a matter for states.

If you make enough laws you can make everyone a criminal. Texting and talking while driving is dangerous but the only way to make everything safe is to ban everything therefore making every act criminal.

Two days ago I was at a stop sign I saw a young woman texting while driving-she had it on her steering wheel and she made a left and the oncoming car which was going straight nearly hit her. She did not even notice the car.

So what’s next, I can’t talk to my passengers? If I have a blue tooth or hands free in and am just talking, how is it different than talking to the person sitting next to me?
