In almost total secrecy, the Obama Justice Department has charged a U.S. Border Patrol agent, Luis Fonseca, for depriving the rights of a yet to be identified illegal alien at the Border Patrol station located on Imperial Beach, California, last July. Fonseca, however, was not indicted until a week ago.
Agent Fonseca, 32, allegedly kneed and choked an unidentified alien during his tour near the Mexican border last summer. During his arraignment on Monday April 16, he entered a not guilty plea.
A grand jury had handed down the indictment on April 12, but details were withheld and the DOJ neglected to promulgate why the legal action was taken against the Border Patrol agent, according to an "Inside-the-Beltway" public-interest group that investigates and exposes government corruption and misconduct.
"Border Patrol Agent Fonseca kneed and choked an unidentified alien, depriving him of the right under the Constitution and the laws of the United States to be free from use of unreasonable force by a law enforcement officer," the U.S. Attorney's Office said in a statement.
According to Department of Justices records, a federal grand jury indicted Fonseca on a single charge of deprivation of rights under color of law. The charge, a civil rights violation, carries a maximum sentence of 10 years imprisonment.

Its a wonder they get anyone willing to be an agent anymore. What a travesty.
That seems like a potentially dangerous precedent to be setting.
Illegal aliens have NO Constitutional rights. This isn’t rocket science, Eric. The entity violating constitutional rights is the DOJ.
The administration’s war on Hispanics continues.

border agent indicted with depriving “civil rights” of illegal alien.
“According to Department of Justices records, a federal grand jury indicted Fonseca on a single charge of deprivation of rights under color of law. The charge, a civil rights violation, carries a maximum sentence of 10 years imprisonment.
The case is problematic...”
You know it's a monkey trial when you're charged against someone they can't prove even exist.
None?
Can we tie them up in public and invite anyone to gang rape them?
Could President Romney forcibly convert them to Mormonism, seeing as how they have no First Amendment right to freedon of religion?
Breathtaking. Just breathtaking.
Gang rape is a crime as is tying a person up against their will. You don’t have to have constitutional rights to be a victim of a crime.
The Contitution and Bill of Rights does not mention any protections for illegal aliens.
Because of that, law enforcement and courts do not have to protect the 1st, 2nd, 3rd, 4th, 5th, 6th, 7th or even 8th Amendment rights of illegal aliens.
“Its a wonder they get anyone willing to be an agent anymore. What a travesty.”
And it will bread more corruption in the ranks. Some of us who have been warning and posting about illegal immigration have been called every manner of ugly one can regurgitate. Those who have defended this crime will one day try to fix the mess and it’ll be too late. It’s likely already too late. They have allowed a new ‘PROTECTED CLASS” to be created. NEVER a good idea! Never.
I don’t know the particulars of this charge yet, it will be interesting.
I can hardly stand reading news any more. It makes me so sick. When is the regime going to be toppled? Are there any Rs with guts, spines and principles? Where are they?
I’m sure the illegal was being very respectful and was cooperating at every order from the officer, right?

Prior to the Obama regeme, I do not recall any instance of federal or state police or courts granting constitutional rights to illegal aliens.
I remember studying this isssue in law school-- and I graduated in 1978.
