What facts that you’ve seen or heard would constitute probable cause?
Remember ... probable cause is a pretty low threshold. Also,I am going off facts I see and read which is absolutely NO substitute for Prosecutorial investigation. In no particular order
1. Armed v. unarmed
2. Police told him not to follow but he did
3. Scream was probably Treyvon
4. Pursuing obviates application of “stand your ground”. He can not avail himself of its protection.
5. Zimmerman seen straddling Treyvon’s body.
6. No evident significant injury to Zimmerman despite claim he was so injured.
7. Girlfriend’s testimony that Treyvon felt he was being followed. Treyvon turning on Martin, esp under FL law, is fine if he felt threatened.
One thing in which I would be VERY interested in would be forensics on bullet trajectory, fingerprints (if Treyvon’s were on weapon) etc.
Please understand that we attorney’s look at this VERY differently from the public at large. Part of my job was to charge a crime if I had probable cause to believe one was committed. This is why Prosecutors and Def attys of all types are being paraded across television and the Internet, almost to a man/woman, saying this is an EASY call. I said from the outset that he should/would be charged with Voluntary and Involuntary Manslaughter. I stand by that.
And I say again (because some people will argue guilt with me) ... this is VERY different from “beyond a reasonable doubt”. I’ll be the first to admit this is, seemingly, not an easy prosecution. But, that doesn’t mean you don’t prosecute it.
