Joe knows full well that any DOJ presence would be the camel’s nose under the tent. He can’t, absolutely CAN NOT, give them any slack at all.
The DOJ under Holder has zero credibility and strongly damaged legitimacy. Virtually all US Federal Agencies are under clouds because of the willingness the Obama Administration has shown to use them as political tools.
Sheriff Arpaio is the first, but I don’t believe he will be the last.
DOJ is trying to get him to agree to this. When it comes to stepping up the attack, they will seek a federal judge to issue a court order.
