I don’t recall in at least the past 35 years any president commenting on not only recent, but even unannounced Supreme Court rulings. Ubama does so routinely. Ubama is not your normal president.

The accidental president, Ubama, is one very sick POS.

I guess Obama wants to rewrite history and throw out all cases in which the Supreme Court overturned unconstitutional laws that were made laws by democratically elected Congresscritters and presidents.

Did he really graduate from law school and teach constitutional law for YEARS?

Appointments refer to situations where ONE PERSON is voted for by one designated voter. In our system the President is the voter.

I don't particularly care for that system, but it is the same as any election, albeit one with a very highly restricted franchise.

Give you another one. The members of the House of Representatives are elected from small districts that fail to represent the entire United States. To increase the franchise to people who don't live there we could probably vote for all of our Congress-critters on a party-list system. You'd get to vote for all of them ~ not just that one local guy.

There a great number of possible schemes for electing folks to office.

I have to agree with other previous posters to this thread that it appears that Kagen leaked the results of Friday’s vote to Obama and his minions. I don’t think it was positive for the democrats.

I think that what we will see is an attempt by Obama to marginalize the Supreme Court just as he has marginalized Congress. Be prepared to hear the phrase, “Runaway activist Conservative Supreme Court,” repeated over and over during the months leading up to the election.

In other words, the entire federal government is broken, it’s Bush’s (and the conservatives’) fault, and we must allow Obama to have another four years to fix it.

I would like to propose a simple definition of judicial activism in the context of our constitutional arrangements, including checks and balances. Judicial activism is the adjudication of cases in a fashion which produces a result inconsistent with the language and intent of the constitution. The “action” in the “activism” is essentially altering the constitution, usually for the purpose of achieving a desire outcome. Striking down a measure which radically expands the power of the government is the virtual opposite of judicial activism or, judicial restraint.

Obama, the brilliant constitutional scholar (major sarc)knows this but uses the word “activism” to confuse the public into thinking that any significant action by the court is “activism”. As dramatic as striking down 0-care would be, it is actually circumscribing government power within the language of the constitution.
