"11:55am - Justice Sonia Sotomayor was first to interrupt the challengers' lawyer Paul Clement, who is arguing that the whole law should be invalidated, shortly after he began making his remarks. "Why shouldn't we let Congress" decide what to do, she asked him. "What's wrong with leaving it in the hands of people" who should be taking this decision, "not us?" she continued."

Illustrating perfectly why we need to keep liberal activist judges from ever getting on the courts (at any level!). The simple answer to her plea is that (a) even the Congress is limited by the Constitution, and (b) the Constitution provides a mechanism for amendment, if that is the will of the people. You can't shortcut the process just because a simple majority or, in this case, a vocal minority wishes to act extra-Constitutionally.

Unfortunately, we're going to be living under the shadow of Obama (Sotomayor and Kagen appointments) long after he's un-elected this fall.

RATS just love to tell us that we are a "Democracy" (mob rule). This argument supports the entire Zero regime's agenda - TRANSFORMING AMERICA FOR THE PURPOSE OF THE WAGON RIDERS WITHOUT ONE SINGLE CONSTITIONAL AMENDMENT REQUIRED. The LEFT has been working on this for a very long time and now they are seeing their chosen messiah is in for a tough slog. Their heads are swiveling and are just about ready to explode. I love the smell of napalm in the morning!!!!

funny how Sotomayor doesn’t want to leave abortion in the hands of the people.

I’d have loved for one of the conservatives to bring that up.

“What's wrong with leaving it in the hands of people” who should be taking this decision, “not us?” (Wise Latina) continued”

The people indeed. In almost three days of proceedings, not a single word or reference to the Ninth Amendment and its sister clause, Necessary and Proper.

If Obamacare is necessary, (it isn't) it still does not pass the proper provision, for it is a bold faced assault on our natural right to select and contract for medical services.

Which is exactly why I held my nose and voted McCain/Palin and will do similarly this fall.

Kagan has left herself wide open for impeachment when she sits on this issue. She has a vested interest in the outcome of the ruling of the court, and since she was instrumental in the pro-passage run up to its passage two years ago, demands impeachment since she rightly should have recused herself.

If the Senate changes hands in January, which is a strong likelihood, her impeachment should be one of the first orders of business in the House, then let the chips fall where they may, no matter who is president!

Because, Justice Sotomayor, it's the job of SCOTUS to determine Constitutionality of laws. Oh, also, because of parachutes, pole vaults, and Pelosi.

And because Pelosi and Reid completely ignored the will of the people. They sacrificed the careers of the (D)s who voted for this monstrous power grab disguised as legislation.
