Panetta has said the death penalty is possible if the soldier is convicted. Command influence. What about the six American military personnel killed by the Afghans in retaliation for the accidental burning of the Koran? Should we demand the death penalty for them?
A recent amendment to the Uniform Code of Military Justice offers a new alternative to the death penalty. For crimes that occurred on or after November 17, 1997, a sentence of life without the possibility of parole is now possible. Prior to this legislation, those servicemembers serving a life sentence would be eligible for parole after serving 10 years.

President Obama on Tuesday said he viewed the killing of 16 Afghan civilians by a U.S. soldier as seriously as if those killed had been Americans. The MSM usually goes to great pains to use the word "ALLEGED" when referring to the common criminal.
No such courtesy is given to a suspected U.S. Soldier. Interesting.

Unless I’m quite mistaken, the UCMJ makes no distinction between Americans and others as to the penalty for murder.
Personally, I find it very odd that quite a few here find it difficult to flatly condemn the mass murder of unarmed people, including children. Unless you believe babies somehow carry guilt for what their parents or fellow citizens might have done.
Obviously we don’t know the whole story, and if the guy indeed has brain damage he might have diminished capability.
But intentionally killing unarmed innocent people should be punished to the full extent of the law, regardless of who those people are.

Maybe if we find one of the victims was a muslim someone will do something?
