Preschooler’s Homemade Lunch Replaced with Cafeteria “Nuggets”

State agent inspects sack lunches, forces preschoolers to purchase cafeteria food instead

RAEFORD — A preschooler at West Hoke Elementary School ate three chicken nuggets for lunch Jan. 30 because a state employee told her the lunch her mother packed was not nutritious.

The girl’s turkey and cheese sandwich, banana, potato chips, and apple juice did not meet U.S. Department of Agriculture guidelines, according to the interpretation of the agent who was inspecting all lunch boxes in her More at Four classroom that day.

The Division of Child Development and Early Education at the Department of Health and Human Services requires all lunches served in pre-kindergarten programs — including in-home day care centers — to meet USDA guidelines. That means lunches must consist of one serving of meat, one serving of milk, one serving of grain, and two servings of fruit or vegetables, even if the lunches are brought from home.

When home-packed lunches do not include all of the required items, child care providers must supplement them with the missing ones.

The girl’s mother — who said she wishes to remain anonymous to protect her daughter from retaliation — said she received a note from the school stating that students who did not bring a “healthy lunch” would be offered the missing portions, which could result in a fee from the cafeteria, in her case $1.25.

“I don't feel that I should pay for a cafeteria lunch when I provide lunch for her from home,” the mother wrote in a complaint to her state representative, Republican G.L. Pridgen of Robeson County.

Here’s what I want to know. Where was the warrent to search the children’s lunch bags/boxes? If there was no warrent, then the search was illegal and the parent imposed fine (nugget tax) is unwarranted.

I've read a few articles about this now, and it seems like the state of North Carolina has decided to take the USDA stuff to the extreme and obsess over little kids lunches. Why, I don't know, since it's NC of all places, but in this day and age, nothing surprises me, even out of states I thought were Conservative.

We have the federal government trying to control education through No Child Left Behind, and we have the states bending over for No Child Left Behind rather than resisting, and now we have the states happily joining in on a ridiculous abuse of power with inspecting kids lunches.

Last week, I sent my GD to school with her healthful *snack* ...a ripe pear with a slicer corer. [I didn't pre-cut it at home b/c it would have turned brown by the time she opened it]The principal called her dad at work....all hysterical...the teacher called me...all of a flutter. It's insane.

If they saw this child *Rachel Ray* chopping vegetables with a sharp knife, in my supervised kitchen...I'd be taken away to a gulag. I know, I'm a bad-bad person.

I am awake so quit frothing at the mouth. I have little use for republicans as well but it is the democrat party that is and always has been behind this push toward socialist dictatorship.

The democrat voters don’t lay down to accept any insult; to them it is not an insult but their vision as well. The republicans roll over at every turn and fail, like the democrats, to realize that if there ever was a movement to actually take back our freedoms as the founding fathers did that they too will be at the point of the sword.

Yes, I HATE democrats, all of them; I merely loathe and despise the spineless republicans.

I spent 22+ years sworn to protect and defend the Constitution and that oath was not voided when I retired.

When I was in grade school, I was given a peanut butter and jelly sandwich, drink, and snack in my lunch most days by my mother.

AND, if you forgot your lunch, you were given a peanut butter and jelly sandwich and a milk.

How did any of us survive our childhoods?

Even worse, they may hurt themselves. Only problem with that is you can’t blame anyone else. And you can’t sue yourself for damages!

Has anyone questioned what happened to this girl's 4th amendment rights against illegal search and seizure? Was there a warrant stating probable cause, the place to search, and what they expect to find?

The schools,like many employers, insist that they have the right to search your bags and lunchboxes as a condition of you being allowed onsite.Of course the school is mandatory,or schooling is mandatory,AND schools insist they acyt “in loco parentis” so ,since a child has no legal protection against parental searches,then school personnel can search too.

WE trot out the 4th Amendment but it has been eviserated by the War On Drugs and the War On Terrorism ,but really by the War On Freedom.

I thought there were court rulings that said that you cannot be made to waive your Constitutional rights when participating in government mandated activities, otherwise those just become de facto stripping of your rights.

It's unconstitutional for a school to make you waive your 1st, 4th, or 5th amendment rights as a condition of going to the school, when the school is mandated on you by the government in the first place.

When was the last time you heard or saw the government employees actually reprimanded,much less fined or jailed ,for violating citizens; rights??

The dirty secret is that even Republican prosecutors and attorneys are not comfortable with actually confronting aggressive government ;I think they all long to (mis)use government power and don’t want to limit it.
