If someone has not been appointed to a position legitimately, is there any reason that any salary payments made to such a person should not be regarded as misappropriation of federal funds? Is there any reason anyone who works to cause such funds to be disbursed, knowing that the recipient was not legitimately appointed, would not be committing a prosecutable federal crime? I know Eric Holder's not going to prosecute, but he's not the only person responsible for federal prosecutions, is he?
