Removing infringing files was *supposed* to be "safe harbor".

The FBI instituted back door SOPA by shutting down and making a test case of file host MEGAUPLOAD!

US government hits Megaupload with mega piracy indictment

MEGAUPLOAD *THOUGHT* they had "safe harbor" by removing files immediately for copyright complaints, without even examining the legal claim. (Porn fighters report and have removed stuff they don't even own.)

The Feds will browbeat the "MEGAUPLOAD 7" into guilty pleas and asset forfeitures.

Then they will intimidate all the others:

Couldn’t agree more. And they’ve paid for this legislation, so back door, front door, side door, somehow it’s going to be implemented. Just another example of our government for sale.

Not gonna happen. Just like usual, the Justice Department will try to intimidate some guys who got rich and have lawyers, and those lawyers will say “under current law, you are not liable, let them take you to court.”

The Justice Department will take them to court and the judge will drop the case.

ACTA is what we all have to worry about.

No. It’s being held until the court finds them not guilty. All they do is provide some servers that save content for independent members. If it is copyrighted, they remove it, thus fulfilling their end of the bargain.

The funny thing is that so many sites have been DDos’ed over this and hopefully will continue to be DDos’ed until RIAA and all those other stone age companies will have to give up.

This is all bullcrap.

BEST case: They search his personal computer and find movies or music, drop the main charge and fine him $175 million and give him 5 years for possessing illegal downloads. Point made to all the other file hosters and anyone else they target. Kim Dotcom has been a lifelong hacker for god’s sake. Probably has a massive collection. What do you rhink really took two years of investigation, MegaUpload or finding out what he personally had and where it came from? You could figure out megaupload itself in 5 minutes.

And I’ve been close to this stuff since 1981.

Doubt it. When they hit the 256-bit encrypted key and SSL on his admin login and hd, they’ll ask him to hand over the passcode. Because of the stress the authorities exerted on him, he has forgotten. 3 passkey tries, HD gets zeroed and oned 32 times. Hell, if you don’t have at least a 128 on your hard drive, a WPA2/EAP with CCMP, you’re asking for it.

I think he’s gonna be fine. Hackers know exactly what they’re doing, and probably know 10X the techniques that I’ve posted. Kim will walk into court with a smile on his face and the feds will jump on him about all the times that other people u/led copyrighted material - and Kim will say “Yeah, and when I received a notice from someone, I DELETED IT.” Go back to your mansion with all that money, Kim.

Kim is never going to get a day in court and he will never get his stuff back and he will never be in the file hosting business again. In a year, neither will anybody else. (Some have just shut down already.) This case will still be going back and forth between attorneys in 2020, assuming Kim can stand some of house arrest in the U.S. that long instead of just taking a 3 to 5-year deal in minimum security now.

And the government will be selectively taking down small-fry websites and users all over the place using those tactics just as if SOPA had passed.

Doubt it. The 4chan kiddies will insure that will not happen even if it means hacking and destroying all supporters of SOPA. Every time Kim gets mentioned in the press the 4chan kids will DDos everything they can. The death knell for the music industry is the fact that during the ringing in of every month, artists are logging on to soundcloud and bandcamp in progressively larger numbers.

The music industry can’t play games with guys like Kim anymore, especially because torrents are doing the same thing faster.
