Gun nuts in the Tennessee state legislature have declared civil war on New Yorkers saying they will retaliate for the prosecution of a woman who was carrying an illegal pistol at the 9/11 Memorial. A resolution winding its way through the Tennessee legislature warns New Yorkers not to drive through their state because the Highway Patrol is gunning for us. A Knoxville-based legislator, who moonlights as a farmer, is so angry over the Tennessee tourists gun arrest last month that his resolution condemns it as a grave miscarriage of justice and reminds New Yorkers to drive carefully if we come visit.
We remind the citizens of New York, especially those residing in New York City, to drive carefully through the great state of Tennessee, paying extra attention to our speed limits, reads House Resolution 585, which urges charges be dropped against Meredith Graves. A registered nurse and fourth-year medical student, Graves was arrested when she tried to check her Tennessee-registered weapon at the 9/11 Memorial in December. Its illegal to carry the weapon in this state. Graves faces a mandatory minimum prison sentence of 3 1/2 years if convicted of felony weapons possession; prosecutors have not said if they will seek an indictment on that or on a lesser charge.

WTF? How exactly is a physician entitled to carry when a salesman or bakery chef or UNIX engineer is not?
You can rest your case. I concede.
I made house calls and physicians like myself carried drugs and cash and were targeted with phony calls.
I do not know the law in Tennessee, but in Arizona, public buildings that are posted against weapons have to have lockers for people to check their weapons in. I have done it many dozens of times at the library, courthouse, DMV, Recorders office, etc.
It makes more sense than leaving your weapon in a vehicle to be stolen.
Amendment 14
“...No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States:”
Looks like a civil rights case to me.
Archy, isn’t there a law with severe penalties for infringing on civil rights under the color of law?
If I were writing that story I would have said he was a farmer who moonlights as a legislator...
What the heck are you talking about? Why would she be looking for publicity? She got a lot of undesired publicity and she might be looking at a fairly long sentence in jail!
Who said they did? The last time I got pulled over by a trooper in WVa I was driving a RED rental car with New Jersey plates. I was doing 79 in an 70 mph zone. Until the trooper saw I had a PA driver’s license, he was strickly prefessional as in, Oh boy, oh boy, I’m going to give this man a ticket There was a definite change in demeanor when he saw that license.
If I had a NJ or NY drivers license, I’d have gotten a ticket.
The thing is that while you’re upset with the likes of Bloomberg and Schemer other people are more upset with the New Yorkers who keep voting these vermin into office.
And don’t forget that Bloomberg has been endlessly trying to usurp the gun rights of people in other states so it’s only fair that New Yorkers are held to account for the tyranny they vote for.
“The 2nd amendment gives this young lady the right to possess a gun.”
Forgive the semantic correction, but it is important. The Constitution does not give anyone any rights and to say that is a very dangerous thing, indeed. Because if you say the Constitution ‘gives’ a right then it can be amended to take away that right, too.
The Constitution enumerates rights that are inherent in men courtesy of their Creator. It makes clear that government ‘shall not’ infringe on those God given rights.
But nowhere in the Constitution does it say that my rights come from a mere document.
It is the city that drags the rest of the state down. It has done so since the Revolutionary War. It has always been on the side of the "enemy".
Give the tickets to the ones from the city, not the rest of the state. Most of the rest of the state would agree with Tennessee, not Bloominidiot's downtown crowd of urban dwellers and assorted welfare scum.
I lived in both places...for many years...and all I can say is..you are CORRECT!
I do recall that at one time New York State refused to extradite black people charged with felonies back to Mississippi because they feared they would not get a fair trial. The victims of these people only got wronged. If New yorkers have problems because of the actions of their state, it’s just too bad. Any one who has not lost the “right” because of conviction of violent behavior and or a felony or because of mental illness and who have not been pardoned or pronounced cured has the right to carry any where in the United States, we have just given up that right and need to take it back.
I didn't know Janeane Garofalo worked for the New York Post.
“She got a lot of undesired publicity and she might be looking at a fairly long sentence in jail!”
This might be where the idiot mayor of NYC screwes up. He takes such a savage swipe at someone who dares to believe a thing aberrent to his majesty, that she is forced to take it to the SC, which must then exempt NYC from the Constitution or let her free.
I had a friend in NYC back in the early 90s when I lived there. He was a vet and had a permit. Carried a Glock 19. I guess his “in” for getting one was similar to yours, ie: drugs, etc.
That was back in the Dinkins years and it was pretty scary sometimes. I regularly traveled through Harlem and the Bronx and might have taken my .357 with me...can’t remember:)
Anyway, years after, moved to CT, got a CCL, but seldom carried. Giuliani happened + NY wouldn’t recognize the permit and I regularly crossed state lines.
By the way...Howard Stern has a NYC/CCL.

Concealed Permit:
May Issue to Residents Only*
The determination whether to grant the license is completely within the discretion of the
licensing officer. However, the licensing officer must state specifically and concisely in
writing the reasons for a denial. A denial can only be overturned in court if the denial is
shown to be arbitrary and capricious.
Issuing Authority:
Licensing Officer of the City or County where the applicant resides, is principally employed,
or where his principal place of business as a merchant or storekeeper is located.
NICS check: Yes
Cost:
A license fee is fixed by the board of supervisors in each county, with a $10.00
limit prescribed by state law. The Division of Criminal Justice Services sets the
fingerprinting fee. The fee for each amendment to the license is $3.00 ($5.00 in Suffolk
County). In New York City and Nassau County, the City Council and Board of Supervisors, respectively, set the license fees without regard to the state law limitation.

possess a rifle, shotgun or handgun in or upon the forestry lands, wherever located, owned and
maintained by the State University of New York College of environmental science and forestry,
without the written authorization of such educational institution.
Deadly Force / Castle Doctrine:
New York is a Castle Doctrine state but has no stand-your-ground law.

PS I am not a lawyer but I did stay at a Holiday Inn Express once...
(A provision of federal law provides a defense to state or local laws which would prohibit the passage of persons with firearms in interstate travel if the person is traveling from any place where he may lawfully possess and transport a firearm to any other place where he may lawfully possess and transport such firearm and the firearm is unloaded and in the trunk. In vehicles without a trunk, the unloaded firearm shall be in a locked container other than the glove compartment or console).
It does cut a tourist a little slack when "transporting a gun through NY but does not apply to loaded arms carried on your person.
