The Jefferson County judge who dismissed a Luverne man's lawsuit to block President Obama from Alabama ballots today also ordered him to pay the state Democratic Party's court costs and lawyer fees within 45 days.
Lawyers for Mark Kennedy, the state party chairman, sought the sanctions in a motion his lawyers filed last week filed last week in the suit filed by Harold Sorensen.
But one of the lawyers said during a hearing today that party officials would not try to collect if Sorensen does not file any similar lawsuits during the 2012 election cycle.
"The Democratic Party has no desire to chase after a retired military man to collect," Barry Ragsdale, one of Kennedy's lawyers, told Circuit Judge Helen Shores Lee.

Of course.
He knew he had lost the case as soon as he walked into the courtroom.

All I can say is there is going to be a lot of counter suits filed if the lid ever blows off this pressure cooker. Orly can start with her $20,000 dollar sanctions fine she got in Georgia. I believe the Georgia judge was the one who said that twittering was an effective way to vet presidential candidates.

If you look at her background, this “judge” graduated from the Valerie Jarrett School of Public Service.

The Democrats drove Sarah Palin from office with endless suits. They all proved friviolous. No penalties were enacted against the Democrat plaintiffs. Now the show on the other foot works just opposit. At some point justice comes from the barrel of a gun.

“The Democratic Party has no desire to chase after a retired military man to collect,”
Unspoken:
“Unless of course he decides to buck the party again,
then we’ll take everything he has.”

“The Founders never intended that these lawyers should have the last word on what is constitutional”
Sure they did. Check out Federalist 78. Hamilton is pretty clear that the courts were the branch in which that power was vested.

“At some point justice comes from the barrel of a gun.”
The Founders figured that out at the Old North Bridge.
Where our bridge might be is still not known, but it’s coming into view.
Washington hasn’t been this afraid since the British were in power in 1775.

I notice the democrat party had no problem with Obama throwing an active military surgeon in jail for 6 months and making him lose his savings, livelihood, and pension simply because he wanted an answer as to whether Obama can lawfully be the commander in chief.

We are definitely headed in that direction at alarming speed.

The right of redress is in there. But there is no requirement that they MUST respond.

Judge Helen Shores Lee, right, of Alabama, speaks with Palm Beach State College student Jennifer Oakes, of Palm Springs, at the Palm Beach County Bar Associations annual Law Day Luncheon Friday at the Marriott in West Palm Beach. Lee encouraged Oakes to follow her dream of becoming a lawyer. Lee, daughter of pioneering attorney Arthur Davis Shores, spoke as part of Law Week.
Growing up in Birmingham, Ala., in the 1950s, Helen Shores Lee faced a constant tug-of-war between what she was told to do and what she wanted to do.
Judge Lee became a judge in Jefferson County in January of 2003. Judge Lee is a graduate of Fisk University (B.A. - 1962) and the Cumberland School of Law at Samford University (J.D. - 1987); she worked as a clinical psychologist (1971 - 1987) before becoming a judge. Judge Lee is active in the American Bar Association, the Alabama State Bar, the Birmingham Bar Association, and the Magic City Bar Association.

To hell with Federalist 78, and screw Hamilton and the horse he rode in on.
The Founders clearly gave the House the power of impeachment, establishing the courts and controlling the court’s purse strings.
The House has the power to crush the judiciary whenever it wants. Assuming, of course, that we can find House members with the stones to turn the situation around.
If not, let’s find out how many generals and divisions the black-robed Marxists have.
