In Act of Defiance, Democrat Stalls Obama Choice for Court

When a Democratic president nominates a federal judge from a state with two Democratic senators — and the Senate itself is controlled by Democrats — a speedy confirmation hearing typically follows.

But in an unusual case of intraparty defiance, Senator Robert Menendez of New Jersey is holding up President Obama’s nomination of a judge to the United States Court of Appeals for the Third Circuit, the only time a Democrat has tried to block one of Mr. Obama’s judicial nominees.

Mr. Menendez would not comment. But the nominee, Patty Shwartz, has been in a relationship for more than two decades with the head of the public corruption unit for New Jersey’s federal prosecutor. And that unit investigated the senator during his 2006 election fight, an inquiry Mr. Menendez has long contended was politically motivated.

Judge Shwartz, now a federal magistrate judge in Newark, a lower-level position, declined to comment. But the connection has led lawyers and judges in the state to speculate that Mr. Menendez is acting out of resentment, rather than any concern about Judge Shwartz’s qualifications.

Menendez is up in 2012...his polls are weak..if the GOP could find a halfway decent candidate...he could be beaten,,

I do not believe that Menendez will back down, he has a phalanx of supporters (or a phalanx of similarly bereaved) crooks in NJ who despise Nobile.

The entire Sharpe James machine in Newark, the entire Hudson county (Dem) machine, the Hoboken (Dem) machine, the Essex county Republican party, the Essex county Democrat Party, the (Dem and Rep) Woodbridge clans surrounding James McGreevey, THe Port Authority Commission, the Meadowlands Commission,....

all of them truly hate Nobile and want to destroy Nobile and his live in wifey.

Here’s how it works... James Nobile was Chris Christie’s 2nd in command when Christie was Federal Prosecutor attacking the corruption in NJ.

Gov Christie’s 3rd in Command at this time was Paula T. Dow, who until this week was NJ’s Atty General.
Christie has nominated Dow to a state Superior Court seat but Senate Democrats are blocking further action.

Jeff Chiesa has been nomintaed by Gov. Christie to replace Larua T. Dow as the NJ Atty General.

Gov. Christie, James Nobile, Laura T. Dow, Jeff Chiesa, and their special prosecution team has been responsible for almost every single political corruption case brought against NJ politicians, bureaucrats and gov employees in the last 8 years.

While Laura Dow and Nobile are nominally Democrats, they are not corrupt machine pols, they have been for the most part white knights trying to root out corruption in NJ at the core...

Menendez’s entire machinery has been and is under investigation at both the state and Federal level. More likely than not Menendez will be subpoenaed and brought to trial again in the coming years. He will fight tooth and nail to maintain the walls of his corrupt fiefdom.
