President Obama today made an unprecedented recess appointment even though the Senate is not in recess a sharp departure from a long-standing precedent that has limited the President to recess appointments only when the Senate is in a recess of 10 days or longer, according to Senate Republican Leader Mitch McConnell (R-KY). It turns out that the action not only contradicts long-standing practice, but also the view of the administration itself. In 2010, Deputy Solicitor General Neal Katyal explained to the Supreme Court the Obama administrations view that recess appointments are only permissible when Congress is in recess for more than three days. Heres the exchange with Chief Justice John Roberts:
CHIEF JUSTICE ROBERTS: And the recess appointment power doesn't work why?
MR. KATYAL: The -- the recess appointment power can work in -- in a recess. I think our office has opined the recess has to be longer than 3 days. And -- and so, it is potentially available to avert the future crisis that -- that could -- that could take place with respect to the board. If there are no other questions
CHIEF JUSTICE ROBERTS: Thank you, counsel.
Speaker Boehner called the appointment an extraordinary and entirely unprecedented power grab, and noted that the position had not been filled for one reason: the agency it heads is bad for jobs and bad for the economy. Somebody (hopefully not the electorate, which has been dumbed-down to the point of not being able to feed itself) needs to call "foul" on this administration and push the restart button.
This guy is so arrogant and so devoted to the notion that this nation needs to be "transformed" that he and his minions will do anything,right up until the end of his regime to further the agenda.
A thumb in the eye of the American public and the concept of the nation at large. The latest of a number of similar actions.
Why this goofball is where he is has and will continue to be a mystery to me, but he and his supporters have to be relegated to the asheap of history.

In response to this, the Republicans will do absolutely nothing except gnash their teeth and scream, claiming it to be a worthy substitute for action.
The truth is, that now that the Socialists have done it, the Progressive Republicans will be able to do it, too. They will not want to fight it.
The people’s rights as established by the Constitution, which was approved by a vote of the States, are disregarded. The sacred pact we all made with each other, is being torn asunder by the gimme classes.
The legal and social contract that is the US Constitution, is treated as void and of no further effect. Our Constitution, you know the one, that living, breathing document, the one that is outdated according to the Socialists’ president, no longer exists in anything other than a vague and general concept, unless it fits the Socialist Agenda.
Like the Pirate Code, it is now really more a set of guidelines meant to be broken, as long as it interferes with the political agenda of those in power. With the court ruling often that a citizen has no standing to sue for violations of the Constitution, the court has denied any method of redress except through the ballot.
And the elections are held according to rules set by, guess who, the ruling elite. Therefore, you need picture ID for everything except voting, so that the only power to affect change is diluted to the extent that it is no longer effective against anyone other than an established candidate, a la Romney.
The parties control the voting and the early primary/caucuses to eliminate the non-establishment candidate before nearly all of the country has a chance to vote.
It is all about control by the few, to set rules for the many, at the cost of our freedom.
I wait for someone to prove me wrong, but there are no great leaders on the horizon in this nation. There is nothing but the hive mentality as established by the Queens in Washington DC.
If Obama is allowed to do yet another tyrannical and despotic act without a fight, a pox on all of them. The sun has set on America. Relativism rules. Standards evaporate. There are no moral absolutes, only to get as much as you can, as fast as you can, from as many as you can.
I hope the entire system fails, and the sooner the better, so we can start again with a clean slate.
Maybe Romney is just the man to hasten the fall.
