Obama bucks Republicans by making unprecedented recess appointment

Congressional officials said President Obama has used his recess appointment powers Wednesday to name a head for the controversial new Consumer Financial Protection Bureau in a move Republican lawmakers said amounted to an unconstitutional power grab.

Mr. Obama made the appointment of former Ohio Attorney General Richard Cordray even though the Senate, which has the power to confirm nominees, considers itself still in session.

But the White House argues Republican senators stonewalled the nominee for so long that Mr. Obama had no choice but to circumvent them.

In making the appointment, Mr. Obama rejected the precedent set by former President Clinton and the precedent Mr. Obama and his fellow Democrats set under President George W. Bush in 2007 and 2008.

“Although the Senate is not in recess, President Obama, in an unprecedented move, has arrogantly circumvented the American people,” said Senate Minority Leader Mitch McConnell, Kentucky Republican.

GOP House Speaker John A. Boehner called the move “an extraordinary and entirely unprecedented power grab by President Obama that defies centuries of practice and the legal advice of his own Justice Department.” “The precedent that would be set by this cavalier action would have a devastating effect on the checks and balances that are enshrined in our Constitution,” the Ohio Republican said in a statement.

Call your Senators now....demand they stop this Unconstitutional recess appointment by Obama....this president has crossed the line! Do we have a Dictator? Stop him....demand it.

This is where Obama has now set the bar. From now on Recess appointments will be the standard practice for any nominee who can’t get past congress. The imperial presidency.

Last night I watched a media person gush on about how
Obama had ascended to the Presidency, as though on
a cloud of glory. Made me sick. This just verifies
my view of reality. The unconstitutional usurper must
go.

Obama is a criminal. Nothing new. This is typical of how he bypasses the Congress. Our real problem is that we do not have a strong, pro-Constitution Congress....otherwise Obama would have been history a long time ago.

Boehner can talk the talk but let's see if he can walk the walk. All he has to do is cut off funding for this Consumer Protection Bureau. We'll see if all these bureaucrats will work for free!

This means a Supreme Court vacancy can be filled, without the Consent of Congress, doesn't it?

This is now a Dictatorship, using Executive Orders, un-elected Czars, and Regulatory Agencies to make Congress un-necessary.

How there is not ONE Republican that would challenge the Constitutionality of all this is beyond reproachable; it's Treason, pure and simple.

It’s bigger than that because they aren’t in recess. Even the White House doesn’t claim it’s a recess appointment, they’re doing it because they say the GOP is obstructionist.

By law they can’t do it, but they are anyway because the GOP doesn’t have the cajones to defund and get rid of the department. This is a Constitutional crisis pure and simple.

Any US senator can now sue Obama in federal court, and win, and though since Marbury v. Madison (1810), the president cannot be compelled to personally obey court decisions, and often don’t, his appointee would be stripped of any and all powers given to him by Obama.

In effect, he could give no legal order, make no regulation, or do much of anything with the force of government behind him. As well, any of his subordinates would be in the same position. Any order attributed to him would be automatically null and void.
