MONTPELIER, Vt. - The two Mexican farmworkers were nervous. Seated in a pickup truck whose driver had been stopped for speeding on a Vermont highway, they didn't know what to expect from the state trooper.
They'd heard of other farmworkers being detained or deported in the largely white state, whose $560 million dairy industry relies on Mexican farmhands like them. But one of the men also had been in a similar stop in New York and didn't get bothered.

Lopez and Sandoval were riding in the truck when the driver was pulled over on Interstate 89 in Middlesex. During the stop, Hatch questioned the two passengers and learned that they may be living in the United States illegally.
Troopers contacted the U.S. Border Patrol and the two men were held at the State Police barracks in Middlesex until they could be processed at the Border Patrol station in Richford. Lopez' immigration hearing in Boston is scheduled for Dec. 6.
The traffic stop prompted Gov. Peter Shumlin to change the state police policy on dealing with suspected illegal immigrants. Under the amended bias-free policing policy, state police will not ask an individual about immigration status.
The commission decision followed a finding in October by an advisory group that said the trooper acted properly and without bias. The State Police Advisory Commission said Hatch had probable cause to stop the vehicle and acted according to his training in questioning the occupants when they seemed excessively nervous, gave inconsistent answers and failed to make eye contact.
But the commission found "reasonable grounds to believe that the law was violated by the officer's actions focusing on the passengers based on race, color, national origin," Appel said.

It’s amazing.
A police officer can stop me. order me out of my car.
Ask if he can search my car. When I say no, that is the basis he uses to have a reasonable suspiscion that I have something illegal in my car and have it searched.
But if I am Mexican or Hispanic he cannot even ask if I am in the country legally.
What a boatload of crap.
They have nothing to worry about. The Illegals have more rights than the citizens or troopers.
I always carry a sombrero and poncho when driving.
Good idea might better get one myself... To get this special treatment
“Ask if he can search my car. When I say no, that is the basis he uses to have a reasonable suspiscion that I have something illegal in my car and have it searched.”
That’s not correct.
Thanks for posting this. These guys need to be dealt with.
we do NOT have "a broken immigration system".
We have a willfully abrogated immigration law enforcement system.
“That’s not correct’’< Yeah? Try telling that to a cop. The 4th. Amendment protections don’t extend to your car. The state gives you the ‘’privilege’’( a privilege is not a right) of a drivers license, the state can poke it’s nose into your car anytime it wants. I found this out the hard way.
No habla ingles.
Actually, he can't.
At least, it used to be that he couldn't. Maybe now he can. But, if so, it's a recent development (last 5 years or so).
That is incorrect and anything that came of that search would not be admissible. Any search, even with a warrant should be the first thing a defense lawyer looks at to win a case. There are too many ways for the government to make a mistake. PC for the warrant, the warrant itself, scope, execution, chain of custody, etc.
Crackdown on illegal immigrants left crops rotting in Georgia fields, ag chief tells lawmakers.
An informal survey showed farmers of onions, watermelons and other handpicked crops lacked more than 11,000 [ ELEVEN THOUSAND !] workers during their spring and summer harvest. Farmers say that's because the Georgia immigration law scared off many migrant workers. Similar complaints are being heard in Alabama with its tough new law.

I've read of apple tree loses in other states, etc. Where are the Americans seeking to do this? Eleven thousand jobs were made available!
Well of course you are right. Once you refuse they must get a warrant, so what they do is have your car towed and impounded, then they rip it apart and you are sucking hind Teat.

That was before permanent classes who simply don’t expect to have to work.

See my Post 16.
If you think an officer asks to search your car and you are going to get back in and drive away after saying No, I believe you will find out different.
