Thursday, December 8, 2011, immediately following the introduction of Attorney General Eric Holder prior to his testimony before the Fast and Furious Committee of Oversight & Government Reform, Darrell Issa requested that Holder be sworn under oath before any testimony began.

This request was apparently in response to Issa’s belief that Holder had in the past misled or lied to the committee and Issa’s desire that if Holder dared again to evade, mislead or tell any direct falsehoods that Holder be held accountable

Issa’s request was denied but not until he was assured that Eric Holder had received a letter prior to his appearance that made it clear to Holder that his testimony was under oath and would be subject to all criminal charges.

Immediately, Michelle Malkin tweeted:

What the...ERIC HOLDER IS NOT BEING SWORN IN UNDER OATH. #fastandfurious

Jim Sensenbrenner picked up the Issa banner and skewered Holder with the reminder that “Lying to Congress is a federal felony,” adding that “obviously, there have been statements so misleading that a letter had to be withdrawn.”

“Nobody in the Justice Department has lied!” fired back Holder.

Sensenbrenner scoffed, “What’s the difference between lying and misleading this Congress?”

Legally, explained Holder, “It all has to do with intent.”

If the intent of the lying is to protect the liar it is acceptable. What in the world is Holder saying?
