Gov. signs bill allowing homeowners to legally kill intruders

MADISON, Wis. (AP) - Gov. Scott Walker has signed a bill that allows homeowners to legally kill intruders.

The bill, nicknamed the "Castle Doctrine," creates a presumption of legal immunity for someone who kills or injures a person breaking into his or her home, vehicle or workplace. The measure requires a judge to presume that the use of deadly force was necessary.

The immunity presumption would not apply to a shooter who attacked someone he or she should have known was a public safety officer.

The Republican-controlled Legislature passed the bill early last month. Walker signed it into law Wednesday afternoon

That’s a pretty slanted headline, “allowing homeowners to KILL”. Why not say something like “allowing homeowners to to DEFEND their lives with deadly force”

This caveat alone makes it a TERRIBLE LAW,

So you are the VICTIM of a no knock raid on the wrong house, you shoot and KILL 3 Jack Booted Thugs, who entered unannounced with guns drawn. What Now??? No “JAck Booted Thug” deserves any “Special Protection” NOBODY DOES EVER.

We are supposed to be EQUAL UNDER THE LAW.

I think that a good weasel word there is “Should have known”.

In a no-knock, there is no time to should-know.

You just watch how the Courts interpret that while you rot in prison.

Everybody Knows that only the POLICE break down doors while being heavily armed and Shoot your DOGS. Therefore you ARE GUILTY.

Have a realistic looking stuff dog near the door (even better if it has a motion sensor attached to a "barking" speaker). If the attackers don't put at least a dozen rounds in it when breaking in, you can presume they aren't cops.

Also, I think the castle doctrine laws aren't enough. I want the state not to merely excuse me, but to pay me a bounty of a few hundred dollars if I bring the ear of a burglar into the police station, like they had bounties on other predators int he past.

No, it does not cover officers if they are breaking in unannounced. I listened to the interview with the senator who was the author of the bill in the senate and he clearly stated the exception was for fire and police AND that they are identifying themselves when entering.

A potential problem with that is your hearing may be diminshed if you are not fully awake and/or a flash-bang explodes close to you.

A reasonable person test is someone busting in your door in the middle of the night not identifying themselves - the homeowner could reasonably assume it’s not police or fire services, because they do identify themselves.
