Virginia Democrats say they will sue to share control of the state Senate

RICHMOND — There are those who question the wisdom of Virginia Democrats, who on Monday vowed to sue Republicans for the right to share control of the state Senate.

Howard is the University of Virginia law professor who in 1996 wrote a legal opinion saying the lieutenant governor has the power to cast a tie-breaking vote on anything before the Senate.

Because this month’s elections left the Senate evenly split between Democrats and Republicans, the GOP has relied on Howard’s analysis to assert that Lt. Gov. Bill Bolling (R) will be able to vote on organizational matters — giving the party control of the chamber and power over its committees.

This is insane.

Government is beginning to break down because liberals refuse the people’s will to kick their asses out of power.

It’s insane because they do not have equal votes. The lt. gov is republican, therefore they always will have one more vote than the democrats if the votes come to a tie.

This will start civil war again. I am not ovestating it. Not when one side ignores governing body rules and laws. You can’t reason with the unreasonable. They are irrational and do not accept reality.

The media paints all stories as good or bad for democrats not good or bad for Americans. It is a shame but it is no longer argueable.

The Virginia Democrats don’t like being in the minority? They should have run a better campaign and now they want the courts to give them what they couldn’t win at the ballot box.

Unless they changed it since I lived there, the only time the Lt. Governor gets to break a tie is when there is a 20-20 split. Of course only a simple majority is needed to set rules and committee assignments.

I remember two occasions when the Equal Right Amendment came before the Virginia Senate. Passage of the Amendment required a majority of Senators (as opposed to a majority of votes cast). This meant that passage of the ERA required 21 votes. Each time, the vote came down to 210 votes in favor, 19 against, with the lone holdout being a Republican who was opposed to passage. On each occasion, the Lt. Governor was a Democrat who was sympathetic to passage. If the Republican voted against, then the vote would be 20-20 which would then allow the Lt. Governor to be the 21st vote needed for passage. So the Republican chose not to vote at all. Thus, the Amendment failed at 20-19 (one vote short of 21), and the Lt. Governor was prohibited from voting since there wasn't a 20-20 tie.
